    Comments: The Bill of Rights mandates that criminal sanctions can only be imposed against an individual who has been subject to due process of law. This includes important factors such as the presumption of innocence, a fair opportunity to answer the charges presented before a duly constituted court and finally the assistance of a well-qualified defence counsel. In the context of capital punishment due process protections gain even more significance. Therefore, it is valid to ask: How adequate is legal presentation,particularly in relation to insufficient economic resources by indigents defendants? In 1984 the US Supreme Court established a two-part test for establishing a claim of ineffective counsel. The Court held that the Sixth Amendment right to counsel "exists, and is needed to protect the fundamental right to a fair trial." As a result Justice Brennan of the Supreme Court declared in 1994 that the "case reports and academic literature are filled with countless accounts of inadequate legal representation in capital cases both at the trial and sentencing phases." These ideas are echoed by Supreme Court Justice Sandra Day O'Connor as well as by her colleague Justice Ruth Bader Ginsburg who declared in a speech in 2001 that "she had yet to see a death case among the dozens coming to the Supreme Court in which the defendant was well represented at trial and that people who are well represented at trial do not get the death penalty." Recent reports of the American Bar Association expressed concern by classifying the indigent defence services as a "mixed and uneven system that lacks level oversight and standards and does not provide uniform, quality representation to indigent defendants in all capital proceedings." The report continues to stigmatize the States' failure to adopt state wide public defender offices or to adequately fund indigent defence services in each county.In short, the defence system gets close to a system of patchwork quality in which serious fairness and accuracy breakdowns are virtually inevitable.

It cannot truthfully be said that it was proven beyond a reasonable doubt that Linda did commit the crime of which she was charged and convicted, so she should not be executed
