Divergent Structure- State courts were functioning originally much different than we know them today. Every person had access to their day in court, arrests were almost all citizen, trials were speedy evidence was put before the court, each had a chance to call witnesses, all were public.

Lost access- Many states either do not allow for non bar certified prosecutions, testimony or block evidence. Observance of Comity,

Secrecy Evidence can be suppressed, any record, testimony and trial. So much can be hidden from the public's eye indefinitely that justice cannot be found. A review would bring to light incriminating and biased information that is deliberately kept to protect the guilty and secrecy promulgates a culture of recklessness.

Abandonment of Corpus Delicti- If you've ever heard the phrase, no victim no crime, it is a form of Corpus Delicti. One theory of law holds that evidence of a crime must exist to validate a prosecution. Corpus Delicti is the latin for that evidence, however, state legislators consistently incrementally add to the types and number of warrentless arrests, possible.

Dismissal State bar has the responsibility to dismiss those whose practice fails to meet standards of decency and competency. While that sounds all well and good, simply, they're failing to auto-police. The Jury would have the right to find Judges and prosecutors incompetent or deficient in justice. It's my personal opinion, that only supervision will create lasting reform, as any rule or administrative structure may be effectively ignored in favor of professional exceptionalism.
