I was married for fifteen (15) years to an ex-military man, who retired after
twenty-two (22) years in the military, then worked for a civilian organization
for twenty (20) years.
When we divorced, I did not reserve my rights to community property, and
erroneously believed that I did not have a right to my portion of his retirement
benefits. Fourteen (14) years after our divorce, I learned that I was still
entitled to my portion of community property, and through a wonderful attorney,
applied through the courts, and was awarded $43,168.03 in arrearages, plus
monthly checks from both the military as well as the civilian retirement.
It is now five (5) months later, and my ex has yet to pay me anything, and has
filed for Chapter 13 bankruptcy. If his bankruptcy is confirmed, as it is set
out in his plan, he will only have to pay me five (5) percent of the total
arrearages. 5%? 5%!
Think this does not affect you? Anyone who has an interest in their ex’s
retirement benefits could be sitting in my shoes in the future. Don’t let this
happen to you or me! This petition will be sent to the
bankruptcy court, our legislators, and governor!
