Persons filling positions of ‘public servants’ are put into positions of great significance and entrusted with a great deal of responsibility and in many cases, the ability to dictate public policy and oversee and enforce laws. This law shall serve the purposes of deterring ‘public officials’ from executing crimes which are in violation of laws, protect the public from the commission of such crimes which degrade the loyalty and respect for these laws and the individuals entrusted to uphold and execute the ‘laws of the land.’ Proposal for sentencing guideline for public officials. The definition of public official is any person elected, appointed, hired, or contracted to fill a position of public service, on public payroll (either directly or indirectly). This law shall include contractors, or the employees of contractors providing public services in any capacity. This law covers and makes subject ‘civil servants’ at any level of government, to include federal, state, city, township, etc. This law shall make null and void any other laws providing protection for crimes committed against any citizen of the United States. There is no indemnification recognized or provided by this law and any and all laws providing such protection and indemnification are null in void. Parole or probation in conviction and carrying out of this law is not to be a consideration in any case. 1. Under this law, any public official, convicted of a crime shall be subject to the maximum sentence for the crime committed within the jurisdiction the crime was committed. 2. Persons found to be in violation of of paragraph XXX are in violation of this law and will immediately be removed from the position, as well as being responsible for a fine of $500,000.00, payable to the county in which they are guilty of the subsequent violation. In addition, of paragraph XXX of this law shall be sentenced to a term of incarceration of not less than 10 years. 3. Any person convicted under this law will have their name placed on an electronic county registry (available on line for viewing) the name(s), original crime convicted of, date of commission of the crime, at the minimum. Persons found to be in violation of 4. Persons convicted under this law will be unable to hold the same or a similar public office, or duty, in the jurisdiction convicted or any other jurisdiction within the United States. 5. Anyone subject to and convicted under this law shall also be responsible for making retribution of $500,000.00 to the county in which the crime was committed. The fine is a condition of sentencing and cannot be dismissed for any reason. 6. Anyone deemed to be an ‘accessory’ to the original crime and aiding abetting a person in committing a crime shall also be subject to the Responsible Public Official law. 7. Anyone found contributing to the commission of a crime that is subject to the Responsible Public Official law, shall be responsible for paying an amount equal to the money associated to the original crime shall have that dollar amount added to their fine, payable to the county where the crime is committed. 8. Fines collected from the Responsible Public Official law shall be used by the county to create and maintain the online registry. Counties shall provide an online link to other counties in order to make the registry in all counties available. 9. Counties, after paying for design and allowing funds for maintenance of the online registry shall use remaining funds to inform and educate the public about the crime(s) committed. Any additional funds shall be used for the county only for the improvement in education.
