Whereas Judge James Rowe has been a perennial friend of the Totten family, has been closely involved with Brad Totten in his legal capacity as an arresting officer, and J. L. Clifton in his legal capacity as a Pocahontas County Assistant Prosecutor and former deputy sheriff; Where Judge James Rowe has demonstrated his bias toward the accused Brad Totten by allowing him to have the most open bail every given to an accused in Pocahontas County; Whereas Judges James Rowe has permitted a criminal with 57 indicted counts to roam unsupervised out of state; Whereas such leniency represents poor judgment and a callous attitude toward the safety of citizens including those whom he is accused by a Pocahontas Grand Jury of raping and sexually assaulted; Whereas Judge James Rowe's leniency permitted Totten to roam at large in the midst of an ongoing investigation by the FBI and the WV State Police; Whereas Judge James Rowe is an active member attempting to remove the Pocahontas County Prosecutor from her office knowing that she initiated the investigation against Brad Totten; We the citizens of Pocahontas County do hereby request that he , Judge James Rowe remove himself from both cases to avoid any appearance of impropriety regarding the administration of justice in the prosecution of Totten and Clifton. In the event that he won't remove himself, we do hereby petition the West Virginia Supreme Court to remove him from both cases.
