Commissioner Rowland, I have been made aware that you are considering substantive changes to the Oil and Gas Regulations for Elbert County. In particular paragraph 5 "Control and Disposal of Produced Liquids" under section F "Performance Standards is the single most critical control incorporated in to these regualtions. Produced fluids contain dangerous chemicals such as benzene, toluene and many other carcinogenic hydrocarbons. In addition these deep wells also bring radioactive materials to the surface. Open pits transfer these chemicals into the air and our gfroundwater. When used on the soil on our roads they cause reactions with other chemicals that produce poisonous compounds that become airborne with each wind or passing vehicle. The argument that industry does not have accidents is fallicoous. The COGCC's own website contradicts this assertion with numerous spill reports. The use of process waters on roads has a documented history of causing defective births of animals and humans and has actually killed animals close to the road. The COGCC does not have priority over our surface regulation of land. Both open pits as well as dust mitigation on roads are Elbert County prerogatives. The Attorney General has admitted such in his public statements. Lawsuits from the State cannot be entered into unto a plaintiff can show actual harm and many exit ramps exist long before any harm may be caused. You have an obligation to be responsive to the voters and citizens of Elbert County as your first level of responsibility. Your own Planning Commission passed these regulations unanimously by a vote of 9:0. Please do what is right and correct for majority of people who just want to live without contamination and impacts to our property values and way of life.
