The Petitioner arrested for using two dairy cases’ to place her music box on. The children that lived up stairs from the petitioner apartment wanted her to bring her music box out side. She retrieved two dairy cases that were in an open field across the street from the petitioner apartment. The next-door neighbor called the police in which the petitioner has had problems before from neighbor and base on her motive was of retaliation. Office Nueze arrived, he got out of the police car looked straight at the petitioner not saying a word to the petitioner as she sit with the children under the tree. Know acknowledge was made. Officer Nunez want over to the neighbor as she was sitting on her side of the porch. The Officer Nunez is servicing time in the Bonneville Federal Prison for drug traffic in the City of Miami Police Department want over and unplug the petitioner music box. The petitioner stated to Officer Nueze what was wrong and that she had a civil right here. Officer Nueze stated that he would take the Petitioner to jail for having illegal dairy, Florida Statute 506.508. Petitioner state that she found the unmark dairy cases across the street in the open field. Petitioner asked Officer Nueze if he could call for his Sergeant regarding the satiation at the location. Officer Garcia the officer that is holding the dairy cases in the picture that the petitioner has provided for this case while petitioner take’s Officer Garcia picture. Sergeant Baralt arrived at the location and joined in with Officer Nueze, fled quickly while petitioner was taking Officer Garcia picture. A complaint arrest affidavit was issue to the Petitioner that the court dismissed as NOLL PROS. The action of the Officers were a violation of the petitioner Civil Rights and the constituent of the United States
