We the undersigned are opposed to the passing or implantation of BY-LAW NO. S-14 A BY-LAW TO REGULATE VEHICLE NOISE IN THE CITY OF FREDERICTON For the following reasons : 1) granting of sweeping powers to Police under a bylaw of detention, search and seizure and forcing citizens to provide incriminating evidence and restricing our rights to freely move about. 2) enacting a law that makes you an outlaw not because of an action or deed, but by virtue of owning a machine capapble of generating a noise past what one city deems loud. 3) Supersecing the current Provincial Motor vehicle Act laws which require the police to observe you committing an offence related to noise 4) focusing on noise enforcement when the death and injury toll on our roadways due to persons driving and engaging in at risk behaviours is taking lives and costing millions in insurance pay outs 5) Purchasing equipment that no province will accept or utilize because it is not accurate. 6) enacting a bylaw that will not "test" a vehicle fairly, not all bikes have the same RPM range and not all bikes operate at the same RPM range, using cylinder size to determine sound allowance as oppossed to engine size. 7) picking decibel levels that are lower than those produced by stationary or semi stationary equipment such as lawn mowers, weed trimmers, street sweepers, buses, generators, tractor trailer reefers and jake breaks, chain saws, vacuum cleaners, mobile steam carpet cleaners. Some of these devices sit stationary and run for hours, others follow a route about the city on a hourly contstant basis. 8) Failure to reach out to the community they serve and ask for concilliation, study and the gaining of a reasonable compromise.
