We don't recommend confrontations over parking Nov 27. 2012 | Comments (0)
Please don't hate the violators. The source of our nation's Handicapped Parking problems, is systematic discrimination which enables violators.
People with disabilities are members of a protected class of citizens in the USA. We focus on existing government systems nationwide, which have failed to educate the public, and accommodate people with severe mobility impairments needing equal access to parking.
We are not qualified to decide which disabilities people have, are legitimate reasons to have Handicap licensing. ADA regulations make it very clear that determination of qualifying disabilities requires a fact-specific individualized analysis of each disabled individual's circumstances.
The AAEHPA does not practice, or encourage confrontations with people we think are breaking the law. (With the ADA's minimal standards requirements, you are more likely to be the driver found in the wrong!)
- You can't confront a car driver, or motorcyclist for taking a Van Accessible space, because the ADA says it's not only for use of vans!
- You can't get police to ticket a handicap licensed driver for parking over your access aisle, because most states don't have statutes making that parking situation illegal!
We do encourage documenting Handicapped parking violations with photographs, and testimonials to help demonstrate what we all have to deal with every time we leave our homes.
