The Declaration of Covenants, Conditions and Restrictions (CCR) dated January 1, 2005 for Paradise Estates under section 4.19 Fence/Wall states that a retaining wall height may not exceed the level of the property for which the retaining wall is being built. This by-law is both unclear and unspecific to what is allowed because every homeowner’s property differs from one another in size, elevation, location and obstruction such as electrical transformer box. The PEHOA board member has stated but not in writing that the specific limitations on constructing a retaining wall should only be 16 inches or two cement blocks in height depending on your property’s elevation which only benefits some homeowners and not all. This by-law should be amended and voted on by the homeowners of Paradise Estates to afford all homeowners the equal benefit to build such improvements on their property. Another note to consider is that the new restrictions set forth by PEHOA on CCR Section 4.19 Fence/Wall is neither in writing or reflected in the current CCR dated January 1, 2005 given to and signed by old, new, potential homeowners. This petition shows that you support potentially changing the CCR by-law under Section 4.19 to allow homeowners of Paradise Estates to construct a retaining wall to the height of 28 inches or 3 concrete hollow blocks. This ideal height for a retaining wall still displays and maintains the beauty and uniformity of the homes in Paradise Estates.  With success and good decision making from the PEHOA this petition will benefit the homeowners of Paradise Estates in a by-law that will benefit and apply to all.
