The Scottish Goverment and Legal System is presiding over a flawed system that creates circumstances whereby individuals are left suffering inhumanely under the mental health act due to the legal system not providing proper legal representations for the individuals whom the Goverment left in a legal grey area when bringing Human Rights Legislation into the Scotland Act. The present system moves the goal posts about based on dates that the government made the decisions and so only individuals who experience the difficulties after the date of the implementation benefits from the specific Human Rights Articles. The legal practitioners go along with this discrimanatory and inequality tenet and since this bill is not going to be passed until perhaps October 2010, it will only people who suffer the injustice after this date who will have legal recourse, this is a blatant falacy in Scottish law and it is the whole legal and political establishment that is working against the Human Rights Convention, and since the solicitors can pick and chose what cases they will or will not take on there is no fair recourse for the individuals who are having their human rights forfeited by these criminal measured acted out by the legal and political systems in Scotland. This may also be true in England Wales and Northern Ireland in Relation to the Equality Bill, it is common practice now in Scotland with Parental Rights where fathers with their names on their childrens birth certificates only get their parental rights automatically if the child was born after May 2005, the rest of us have the choice of forfeiting either our parental rights or go ahead with the legal writ in court that contests the mother V's the father and that is clearly and unequivocally surrendering your rights to equality and non-discrimination as well as being inhumane if you have been subjected to the mental health issues for over a decade whilst waiting for the protection of European Legislation.
