Currently if a first responder/ health care worker is stuck with a dirty needle the source patient,s blood cannot be tested for HIV/ hepatitis without the patient's consent. I am proposing that whenever there is an occupational exposure to a blood bourne pathogen that the source patients blood be tested anonymously w/o consent. Anonymous testing would prevent the results from becoming part of the patient's medical record but the person that is exposed would have peace of mind that they have been exposed to a fatal illness. It would help them in deciding whether or not to take antiviral medications to prevent the illness. New York currently has a law that allows testing in certain situations. I am a health care attorney and when I get paged by an anxious nurse or doctor that has just been stuck with a needle I have to tell them they cannot test the patients blood without consent. There have been situations when the patients refuse,have left the hospital or are unable to give consent.
