As of now New York State Laws prohibit sealing provisions for those previously convicted of a felony offense, outside of those who meet certain guidelines. These guidelines disqualify many ex-offenders from seeking pure rehabilitation regardless of the time that has lapsed since the offense, or achievements accomplished since the offense. The State does however provide certificates of relief and disabilities, which allow some relief but still render the ex-offender disenfranchised from seeking career orientated accomplishments. This petition is to have NYS CPL 160 amended to include provisions for felons outside of the current scoop of provision, which as mentioned above, provides for drug offenders. This amendment is to include but is not limited to certain felonies, and first time offenders. Such amending will include time guidelines before seeking to seal one's record/offense, and showing of rehabilitation, and integration back into society. Amendment to this current provision will provide for disenfranchised New Yorkers to pursue fulfilling careers and lives.
