We wanted to be a part of that growth and future. To put a trash transfer station in this vicinity will only keep our community at the bottom of the heap with bringing in any quality home-building, businesses and schools. Moreover, this rezoning would grant a special privilege to the property owner at the expense of the surrounding community. The Supreme Court of Georgia has ruled that this type of zoning, called "spot" zoning, is illegal and will be struck down (see East Lands v. Floyd County, 244 Ga. 761 (1979)). This is particularly true where a spot zoning decision is inconsistent with a county's comprehensive development plan. Although the Board of Commissioners has considerable discretion, it is not permissible to rezone a particular piece of property in a way that is inconsistent with the surrounding area just to satisfy one property owner.Flag
