Disability Clothing Should Be GST Free

THE HOUSE OF REPRESENTATIVES

draws to the attention of the House:
Adaptive clothing is clothing specifically designed for people with an illness or physical disability and the clothing is not used widely by people without an illness or disability. The clothing is worn by people who cannot dress themselves and require a carer to assist them to dress or undress.
Adaptive Clothing is Tax exempt in the United States of America, Canada, and the United Kingdom, but is not Tax exempt in Australia. Adaptive Clothing should be exempt from Tax in Australia.
We therefore ask the House to:
Amend Schedule 3 of the GST Act to include Adaptive Clothing in the list of 'medical aids and appliances which are used by people with various illnesses and disabilities'. Section 38-45 of the A New Tax System (Goods and Services Tax) Act 1999 (GST Act) provides that a supply is GST-free if:
(a) it is covered by Schedule 3 of the GST Act (medical aids and appliances), or specified in Schedule 3 of regulation 38-45.01(1) of the A New Tax System (Goods and Services Tax) Regulations 1999 (GST Regulations), and
(b) the thing supplied is specifically designed for people with an illness or disability and not widely used by people without an illness or disability.
