The petition
We, the undersigned residents of Irvine, CA do hereby request that the mayor and city council enact the following:
"No utility box greater in size than twenty-four (24) cubic feet or forty-two (42) inches tall shall be located in any area zoned 2.1, Estate Density Residential; 2.2, Low Density Residential; 2.3, Medium Density Residential; 2.4, Medium-High Density Residential; or, 2.5, High Density residential without first obtaining a special use permit. Prior to the issuance of a special use permit, the City of Irvine City Council shall hold a public hearing in order to provide the public an opportunity to comment on the application. A special use permit may be obtained through the following procedure:
a. The applicant must first notify owners of property located within a one thousand (1,000) foot radius of the proposed site, in writing, at least thirty (30) days in advance of the public hearing. The notice shall include, at a minimum, a precise description of the location of the proposed utility box or boxes, the number of utility boxes to be installed at the site, the size of each utility box, and the date, time, and location of the pubic hearing to be held pursuant to the foregoing.
b. Each site shall require a separate application and no more than one application shall be considered at each public hearing.
c. No more than one public hearing shall be held each month to consider a special use permit under these regulations.
d. Prior to granting a special use permit, the City Council shall consider any negative impact that the placement of the utility box or boxes may have on the residential character of the neighborhood.
The foregoing requirements shall not apply to the installation of utility boxes necessary to provide public safety such as traffic signal controls. Any utility box installed prior to September 1, 2006 shall be grandfathered and shall be exempt from these regulations."
