AN ORDINANCE AUTHORIZING THE VILLAGE OF WEST JEFFERSON TO BUILD A GYMNASIUM, STORAGE ROOMS, KITCHEN AREA, CONCESSION AREA, RESTROOMS AND MEETING ROOM AT CONVERSE PARK (“THE JACK ROCK MCDOWELL ATHLETIC COMPLEX”), FOR OPERATIONS OF THE WEST JEFFERSON YOUTH ATHLETIC ASSOCIATION (“WJYAA”), THEIR YOUTH PROGRAMING AND EVENTS & COMMUNITY USAGE WITHOUT RAISING TAXES

WHEREAS, The Village of West Jefferson recognizes the need for youth programs, specifically youth sports that have been in operation in the village executed on behalf of the West Jefferson Youth Athletic Association, Inc., (“WJYAA”) for over 20 years, and;

WHEREAS, The Village of West Jefferson recognizes and will continue to utilize the West Jefferson Youth Athletic Association, Inc. , (“WJYAA”) a volunteer non-profit organization offering youth sports with an organization PURPOSE as follows to implant firmly in the children of the community the ideas of good sportsmanship, honesty, loyalty, courage and respect for authority, so that they may be well adjusted, stronger and happier children and will grow to be good, decent, healthy and trustworthy citizens, and To inspire respect for the law; to promote patriotism and work for friendship among all people; Provide education of, develop youth and promote athletic activities among all youth without using illegal drugs and being alcohol free; and to do all things necessary and lawful under the laws of the state of Ohio to accomplish the same in and for this organization. Provide athletic and recreation opportunities for the youth of West Jefferson, Ohio. For Kids About Kids; In accordance with Section 501 (c) (3) of The Federal Internal Revenue Code, the WJYAA shall operate exclusively as a nonprofit organization by providing community sports and activities for this community and surrounding area’s youth. No part of the net earnings shall benefit members of the Board, Members by dues, or individuals associated with the WJYAA as volunteers or coaches except that the West Jefferson Youth Athletic Association shall be authorized and empowered to pay reasonable compensation for services rendered and to make payments and distributions in furtherance of the purpose set herein, and;

WHEREAS, The Village of West Jefferson approved and authorized (“WJYAA”) to have full unlimited access of building operations such as scheduling events or outside groups wishing to rent or use the Galbreath Hall facility, And;

WHEREAS, The Village of West Jefferson recognizes that the Village Council and their lack of budget approvals have neglected to maintain the Galbreath Hall building in a safe functional standard which resulted in a negative safety structure report from URS Structure Engineer Firm on April 3, 2014.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF WEST JEFFERSON, STATE OF OHIO

SECTION I.

West Jefferson Parks and Recreation Committee is authorized and shall work with the “(WJYAA”) and its executive board to create and approve building plans for construction of the new building. The Parks and Recreation Director or Public Service Director shall be held accountable and responsible to fully execute and oversee the construction of the new building and put any items before the Village Planning and Zoning and apply for any applicable permits. The Director(s) shall ensure the construction work is expedited in a manner with a forecasted project completion deadline of December 30th, 2015

SECTION II.

The location of the new building shall be built at Converse Park or The Jack Rock McDowell Athletic Complex on the space formally occupied or known as the skateboard park which has been vacated of all skate board ramps for almost 2 years OR shall be built just EAST from the skateboard park location along the fence line over the gravel parking lot south of Stanley Electric Field. If these areas are not possible the Village Council will make Converse Park area a suitable location without removing any current sport field and diamond area however could relocate the basketball court if necessary. Or Execute land purchase at 177 Frey Ave with the school

SECTION III.

The funding appropriations for the building shall authorized & use all cash available in village accounts designated for parks and recreation spending or lands and buildings up to $300,000.00 and shall authorize the village to borrow remaining needed funds with low interest loans terms not exceeding 20 years however the overall cost of the construction and final cost of this project shall not exceed $800,000.00

SECTION IV.

To reduce overall project costs and spending allowances the Village of West Jefferson shall work with their Law Director and seek possible avenues to purchase or build the building under the WJYAA legal name, WJYAA shall take necessary ownership rights while under construction and immediately return ownership lawfully to the village as allowable by the State of Ohio and Federal Tax Exemptions Laws or Codes and executed agreements of both parties. The West Jefferson Youth Athletic Association will also provide tax emptions for donations of materials or goods used for the building and timeline donor naming rights.

SECTION V.

The building shall have removable gym floors for basketball, indoor soccer and volleyball and the gymnasium size of at least 100’ X 120’; court side 55' x 80' with additional space if needed for spectator seating, additional space for restrooms, storage room, concessions area, kitchen area, additional accessible restrooms from the outdoors, Movie Projector Big Screen and Movie Projector with speakers and sound system, interior and exterior operational security cameras, both burglar and fire alarms.

SECTION VI.

A Legal Lease Agreement will be fully executed and maintained between both Parties, The Village of West Jefferson and West Jefferson Youth Athletic Association to continue operations as outlined herein this Ordinance which will outline that the Village of West Jefferson will continue business as usual to provide routine maintenance to the facility and grounds, remove snow on the parking areas and sidewalks around the facility, property and hazard insurance, cover utility costs both gas and electricity and water. Any rents will be given to the Village of West Jefferson to cover costs of the building. The Lease shall be for $1; automatically renewed every 5 years until WJYAA no longer occupies the structure or no longer exists.

SECTION VII.

The WJYAA Executive Board shall have unlimited accessible access to the building and WJYAA Events or endorsed functions shall have priority and shall have the exclusive rights to schedule other community events around WJYAA Events or youth functions for a rental fee.

SECTION VIII.

This Initiative Ordinance or Ordinance shall take effect and be included in the Village Ordinances at the earliest date permitted by Law.
