I also believe that Mr Nearly should be well represented by an experienced defence lawyer.
I also believe that for a fair trial the jury should comprise of a balance of Black, white and other ethnic groups.
I believe very strongly that a retrial should take place with all the facts revealed to the jury.
Maybe you could explain how how can a trial, without all of the evidence and facts of the case being put forward be a fair trial?

| 47 | Darrin | Fisher | Our system is filled with people trying to shut cases too quickly and ignore facts that would vindicate a suspect. It's like they pick out a person they believe to be guilty and then they force the puzzle pieces to fit. This entire case is a clear example of that. A good friend of mine is currently sitting on death row here in Texas and her attorney told her half way through the trial that if they stop fighting now, she would have a good shot with an appeal for ineffective council. That is sickening that anyone would allow their client to be convicted instead of fighting the entire time. Looking at this case, it appears they must have had the same lawyer. Anyway, I wish you all the best in getting this case to trial again. He clearly deserves to be heard. What is truely sad is that it takes a person to be sentenced to death and they have to find it deep within themselves to fight against all odds just to get the truth out. When all along the truth should have been told the first time and people should have listened the first time instead of wasting a mans life because "someone has to pay". This whole "eye for an eye" attitude has got to end. Too many innocent people have lost their lives to the Texas prison system and for no other reason than a breakdown in justice. What ever happened to "it's far better to have 12 guilty people go free than one innocent person spend one day in prison"? We are so far off track now, we may never get back on. All we can do is abolish the death penalty all together and spearhead an new system for trials. No more racially biased trials. No more trials where economic status is a factor. No more sending people away for crimes they didn't commit. We need a new system and we need it now.
