The petition
We, the citizens of North Carolina, do hereby petition our state legislature to sponsor and pass the "North Carolina Medical Protection
Act".
Under current North Carolina law, hospitals and other medical institutions have the right to seize and/or place judgements against the primary residences of patients who have hospital and medical debt that is not covered by insurance and that the patient is unable to pay.
The current North Carolina Homestead Exemption Bill only protects the first $20,000.00 of the primary residence of married homeowners and the first $10,000.00 of the primary residence of individual homeowners againstseizure by hospitals and medical providers--even if the patient files
bankruptcy.
This interferes with our citizens' basic housing needs whichshould be protected by the laws of our state. The purpose of the "Medical Protection Act" is to protect the primary residence of North
Carolina citizens who have outstanding hospital and/or medical debt against any hospital, physician, group practice, or medical institution
of any type seeking to settle the debt by pursuing a legal judgement against the patient's primary residence.
By signing your name to this petition, you are taking the position that a hospital, medical
practitioner, group practice or medical institution of any type should not be able to force the citizens and homeowners of North Carolina to choose between their health and their home.
Additionally, you are asking our lawmakers to add North Carolina to a growing list of states including Florida, Texas, Oklahoma, Minnesota, Kansas, Iowa, South Dakota, Massachusetts, Nevada and others by enacting legislation that will
comprehensively protect the primary residence of every citizen of our state from seizure or lien placement by medical providers in order to
settle medical debt.
