I feel that it is every husband’s responsibility to provide for child support however paying maintenance to qualified women in childless marriages who voluntarily incapacitate themselves must be stopped outright.Flag

In ancient era this law was ok when females are not allowed to study, not to go outside and get married in early age for being house wife. Hoe they are getting equal opportunity and more easily getting the job. In this situation giving maintenance is wholly unjustified. When govt. is taking the responsibility of its citizen for the maintenance, then how it is fair to direct husband to pay the maintenence to those wives, who are not performing and marital duty. On humanitarian ground, maintenance may be provided only for the max. period she resided in the husband's home. i.e if she files a case after six months of marriage then maintenance can be given maximum for six months.Flag

Close to 3 Crore cases are pending across the various honorable courts of the country (more than 30 Lac in the 21 Honorable High Courts and another 2.63 Crore amongst the subordinate honorable courts). Removing the 'multiple' cases on the same subject matter should ease the burden on judiciary as well. Maintenance is one such area. The Govt should realize that making multiple laws for the same offense also adds to the huge pendancy of cases (E.g. 498-a and DP Act - wife goes and files the two cases in two different cities). Verma on Jan 5, 2010Comments: Sir please consider this argument: When these maintainance laws were enacted it was presumed and to some extent right that the female/wife was deprived of equal oppurtunities in the society to live,earn or maitain herself. But the things are gone way beyond now. Now over the years, the Government has created such female benefiting laws and other avenues like reservations, special treatment etc. to empower the today's woman and she is enjoying equal( if not more than), oppurtunity to earn, live and maintain herself in society at par with male. So, the age longed preception of husband being liable to maintain her wife should be stripped off if not it should be atleast reconsidered to give equal justice to husband as per natural justice. Court's (specifically Delhi HC) in India do understand that failed marriage are not crime and the marriage is an sacred agreement of equal responsibilties and rights of both husband & wife. Why husband should only be panelized for failed marriage when wife also do sworn with her own free will as life partner to the marriage? So the responsibilities of matrimonial relation should be equal among the two partners and if marriage fails, both should take the panalities in equal share. So, it is the call of time to scrap the multiple maintainace laws and specifically add the provision that if wife is employed she does not have the right to go in court for any kind of maintainance. Also the presumptions under this Act should be gender neutral means if husband being disabled or unemployed and is bound to give maintainance to wife it should also be true in reverse.Flag

Name: Arun Gulati on Jan 5, 2010Comments: Request: 1) Only 1 maintenance 2) Be implemented ASAP 3) Income Tax Returns if given by either party, must be scrutinized & issue seen in full light 4) Assets with fair Market price be considered 5) Maintenance is to be borne by either SPOUSE 6 OR Sate/Govt should bear the maintenance expense. 7) Wifes Educational Qualification must be considered. 8) If she is not working, Govt should give job or demand that no maintenace will be paid. 9) Depending the girl's qualification, Govt must give employment / if she does not take job, she is not entitled for any relief from any source. 10) Must work for the money. 11) Stop the husband from being used as an ATM machine. 12) The punishment for false information/affidavit should be so severe that no one tries to play with the LAW 13) The case should not be allowed for more than 6 months in any COURT. We are talking about the fabric of LIFE itself. NO EXCUSES BE ENTERTAINED in this respect at all. 14) If Judgements are unfair, the Judges should also be held accountable and severely penalized, not only that we spend our money in Higher Courts to get the relief.Flag

The multiple laws/acts/sections declaring maintainance to women only help in creating statistics of high number of cases which unscruplous women file to extort money and with criminal intentions to harrass the husband and family. Not only the husband but his whole family has to suffer just for the sake of satisfaction of greed of one woman. The lives of so many parents and siblings of this husband are jeopardized and ruined for the benefits that a false complainant gets from false Domestic Violence accusations.
