We the undersigned residents of Hen Island (Kuder Island Colony) summit this petition in opposition to the application presently before the Rye Zoning Board of Appeals as Application #07-61 by Gary Ederer, owner of site #27 requesting to reestablish a non-conforming use under Article VII,sect;197.5, Par. 4 and 6 and to obtain a building permit for reconstruction of the house. Our reasons are as follows: 1) Site # 27 has not been occupied as a residence for over twenty-three years. 2) Site # 27 has been abandoned since 1984. 3) Site # 27 has never had an interior working bathroom in the structure and was only serviced by an outhouse pre 1984. 4) By assessing the present condition of site #27 it appears this structure will have to be replaced in its entirety, not renovated or rebuilt as listed in the submitted application. 5) Any variances granted to this applicant should be conditioned upon compliance with all current Fedral,State,County and City codes regarding building, zoning, water, and sewage. 6) The applicant doesn\'t show proposed treatment of gray water from kitchen and bathroom sinks and shower. 7) The applicant does not show how he plans to comply with current sanitary codes regarding domestic water. 8) The applicant recently purchased site #27 and created his own hardship in doing so. 9) The Board of Directors and/or Mr. Ederer failed to give proper hearing notice to all homeowners on Hen Island regarding this application. 10) Hen Island (Kuder Island Colony Inc.) is currently a defendant in a Supreme Court lawsuit involving failure to comply with the current federal, state and local building, health, safety and sanitary codes. Any granting of any variances would only allow these serious violations to continue.
