I also counseled half a dozen of his other victims, and spoke with many more. There has never been ANY doubt in my mind as to his guilt in the case brought to trial as well as in more than a hundred other charges which were brought against him. Further, I myself personally witnessed the pre-trial judge offer him the 10-year plea bargain IN OPEN COURT, with Merzbacher and his attorney sitting before him, along with many other court attendees. I cannot believe that 1) no record of this offer and refusal of a plea bargain can now be found and 2) that this new judge believes he knows better than the judge and jury who were the triers of fact in the courtroom when Merzbacher finally was brought to justice. This is a travesty of the most abhorrent sort, and I urge that all measures be taken to keep this very dangerous man behind bars where he can do no further harm to innocent children like Liz and her classmates. He not only raped and tortured them, he gave them alcohol and drugs...several of his victims have since died as a result of overdoses, in an effort to end the pain he inflicted on them. FIND THE COURT RECORDS DOCUMENTING THE PLEA BARGAIN OFFER. His attorney at the time, Christina Guttierez, had many charges of unethical conduct lodged against her and would not have though twice about lying for him in this regard. Someone has failed to do due diligence in this case and this new judge should be ashamed of himself. I now live in North Carolina but would not hesitate to testify as to the facts of this matter, in order to keep this man in jail where he belongs. Someone is now being manipulated by a master psychopath, and it must be stopped.Flag
