 Dear Ministers of the Quebec National Assembly,

Parents of children in the Quebec school system and the general public were pleased with the decision of the Supreme Court regarding the legality of Bill 104 which has opened the door for you to loosen the regulations governing admittance to English schools.

     Quebec’s strict language laws have forced the majority of children in public schools to attend French-language institutions unless they qualify for a “certificate of eligibility” to attend school in English. Prior to Bill 104, students who attended private English school for a year could earn this eligibility for the English public system.

     On October 22, 2009 the Supreme Court of Canada released its unanimous ruling on Bill 104 effectively throwing out two Quebec government appeals to preserve this legislation. The court called Bill 104 “excessive” and lacking nuance, and gave Quebec one year to replace the law that conforms to the Canadian Charter of Rights and Freedoms.

     In the same way that we, the citizens of Quebec, must abide by the laws established by the Quebec National Assembly, that same legislative assembly must abide by the rulings established by the court under which it governs. But we fear that the compromise legislation will not favor the citizens of Quebec and the English schools of Quebec. 

     Presently, the culture of Quebec, both French and English, continues to be promoted in our English schools as our children are being taught both official languages of Canada. We are proud of the services offered by our English school boards and we want to see this service extended to at least the levels we had before the introduction of Bill 104.

     A democratic society is founded on the right of its people to choose within the legislative rules set out by the democracy. We the citizens of Quebec who have, by our right to choose, elected you to our government, call upon you to protect our rights and freedom of choice for the language of schooling of our children and to protect our culture for the generations to come.
