Louisiana House Bill 762 : Provides for a minimum mandatory sentence of one year imprisonment for intentional acts of cruelty to the infirmed. Present law defines cruelty to the infirmed as the intentional or criminally negligent mistreatment or neglect by any person, including a caregiver, whereby unjustifiable pain, malnourishment, or suffering is caused to the infirmed, a disabled adult, or an aged person, including but not limited to a person who is a resident of a nursing home, mental retardation facility, mental health facility, hospital, or other residential facility. Present law further provides that whoever commits the crime of cruelty to any infirmed person, disabled adult, or aged person shall be fined not more than $10,000, imprisoned with or without hard labor for not more than 10 years, or both. Proposed law provides that if the act is intentional, the offender shall serve one year of the sentence of imprisonment imposed without benefit of parole, probation, or suspension of sentence.
