I have lost at least $40,000 in profits since May 1st, 2009.
Michael Brush from www.Yalecousel.com look at the lawsuit that NAMB filed and found tons of problems with it, and laughed when he read the actual HVCC Agreement.

2/16/2010 Someone just pointed out to me the lower level donations on the Donate to the Legal Fund Page were grayed out and not accessible. I have repaired that and will send emails to everyone who have signed so far so they know it was a programming error, not by design. (I wondered why the donations were getting bigger and bigger? Sorry my friends, I have repaired it just now.

2/16/2010 Below is a letter I just sent off to someone I admire who thinks that HVCC will expire on its own. (Rumors):
To my admired Colleague:
HVCC will not expire on its own. It was started by Cuomo because he got
paid off by by TAVMA and other lobbyist for the AMC/Big Bank/Title
firms. He was on the Board of (Directors) Legal Advisers for AMCO, and
that puts him into a major Conflict of Interest position when he came
to violate Anti-Trust Laws by taking commerce from one group and giving
it to another. Also by-passing a whole pile of other Federal procedural
acts. A State Official is not supposed to set Federal Policy, and since
Fannie and Freddie are now Federal, for all practical purposes, he
needs to go to jail, not to run for the Governor of New York using
money stolen from me and most other independent appraisers. (see the
3rd link down on my petition page.)

I had heard that HVCC has now spread to FHA as of TODAY!! I know it is
supposed to (rumored to) have a Sunset provision, but how can that be
when the original case Cuomo filed where he blackmailed Fannie and
Freddie, is still an open case? We have to get HR 3044 passed. It has
123 Co-Sponsors right now. thomas.loc.gov
The (maybe our) attorney, Michael Brush, is licensed on the Federal
Circuit up to the Supreme Court, and in NY and CA. Through his connections in the Federal Arena thinks he can get HVCC canceled
without even going to court. (I met with him for an hour, [no charge]
and brought him tons of evidence.) I used him 20 years ago, and he got
me $15,000 (20 years ago) by filing against a City for violation of
my Human Rights in Federal Court. He is fair and honest and would not
ask for a retainer if he did not really think he could do something. (I
know, I have tried to hire him a few times in the past and he told me I
did not have a case.) [again free consultation] Just my opinion....
(really Michael knows how to play legal hardball)

Sorry it has been over a month since I last updated this blog. But as you all know we are working night jobs and other second jobs to pay the bills and the mortgage, and some of you have even lost their homes. I do this stuff in my spare time which, like all of you I do not have much of.

Also, if any of you are California Appraisers please go to www.cacap.org and join the California Coalition of Professional Appraisers. It is only $50/year. It is modeled after the Illinois Coalition of Professional Appraisers. Once we have a majority of the states in the US start one in each state we will form a National Organization.
Meanwhile, we will fight with this petition and the LEGAL FUND to KILL HVCC with TEETH.

As we build a team in LA, and get
better and filming and recording the best 15 or 30 second sound bites
with electrifying Video, and posting it at least weekly, bi-weekly,
or daily, we will start to get some press, and as we collect all the
small great sound bites, we can put them into a 60 minute, or 30
minute show on 20/20 or 60 minutes, or something, or just sell them to
Cuomo's gubernatorial opponent.

Please, you know me, Joe the Appraiser, my main profession, Residential Real Estate Appraisal has been wiped out by a State Elected person. http://www.ipetitions.com/petition/kill_hvcc/ That person is the Attorney General of New York State. He has through his vast Network of Powerful friends and allies, gotten Fannie Mae and Freddie MAC to agree to HVCC (Home Valuation Code of Conduct). This agreement has put virtually all Residential RE Appraiser out of business, unless they want to work for minimum wage. I went to College for 4 years, worked as a Trainee RE Appraiser for 2 years before I got my license. Now the business is run by Appraisal Management Companies, (AMC's) who want me to work for 75% less than I used to. Please, sign this petition and call you Federal Legislators and have them pass the bill HR 3044 which will put a 2 year moratorium on HVCC.
Still looking for volunteers to help with the HVCC Documentary. I know the first video I made is not very good at all, it was just meant to test the equipment and show that we have an HDV cam, and need better lighting. My wife has agreed to shoot the next one so it will be much better.

I am writing to ask that you support amending S.3217, the “Restoring American Financial Stability Act of 2010”, to include Section.4312 (Appraisal Independence Requirements) from H.R.4173. This important provision from H.R.4173 has not yet been included in S.3217.
Appraisal Independence Requirements, as set forth in Section. 4312 of H.R.4173, assures that the over 100,000 appraisers across the United States, of which over 14,000 of are in California, will have the opportunity, thanks to Congressional action, to interact with appropriate regulators and direct, or redirect as determined best, new and more responsive rules effecting this important industry. Of greater significance, it means that progress, which was the intent of the HVCC (Home Valuation Code of Conduct), an administrative decision that lacked Congressional contemplation, initiation and direction, can be appropriately redeveloped.
The appraiser must stand apart in the mortgage process. There should be no room for compromise in this regard. The appraiser is the “sentinel on the wall”; they are the only participant in the process that does not stand to profit. Please help us, help you, insure a balanced, equitable and reliable process for America’s home mortgage consumers.
