We, the citizens of Kay County are requesting a Moratorium on the opening of any landfills in Kay County Oklahoma for 2 years while the Committe (made up of the County Commissiners & local citizens) develops comprehensive landfill regulations pursuant to the Oklahoma Solid Waste Management Act which authorizes local governments to establish additional regulations on landfills in their area. Oklahoma Staute 27A 2-10-202 (B)
Requirements:
A party seeking to operate a landfill must apply to County Commission Board for a county permit; there is a non-refundable application fee of $500,00. plus any additional costs incurred in processing the application; a study must be done to establish that a landfill is needed in the area; all roads determined by the Board & Citizens Committee to be in need of imporvements must be inproved at the applicant's expense before landfill construction may begin; a $4.00 per ton tipping fee is added to each ton received at the landfill; a majority vote at a special county elections is needed to approve the landfill at an additional cost of $30,000; the operator must maintain a $10,000,000 liability policy; and there are specific location restrictions, such as, the landfill cannot be located within 5 miles of a dwelling. Other restrictions & or limitations may be decided by the Committee as they believe are needed. |
