I am writing this because the Assistant DA (John Roberts) wont prosecute Mr. Thomas Trammell for killing one of my dogs, (Sophie) and wounding Chloe. The Assistant DA said he won't prosecute because our dogs were on Mr. Thomas Trammell's property and because the Assistant DA believes what Mr. Thomas Trammell said. We even have a witness to the whole shooting and the Assistant DA made his decisionbased on Mr. Thomas Trammell's "Perceived Threat" not based on evidence and the eye witness's account of what happened only because he is to lazy to take on an animal rights case and claims it to be civil and not a criminal case.

The penal code in Texas says that the animal has to be in the act of hurting or threatening. My dogs were just standing in the driveway, not inside their fenced yard.

Here's what happened:
This all happened in a matter of 5 minutes. On Saturday July 19, 2014 around 11 am We were getting reading to go fishing and the dogs got out and started playing in our yard. Our dogs have never left our yard before but I guess because of dog curiosity they managed to crossed a 4 lane highway and went over to Mr. Thomas Trammell's driveway. My dogs have never left the property. I don't know why they did this time. Mr. Thomas Trammell or any of the other occupants where not outside. Sophie and Chloe where just sniffing around minding their own business in the driveway. Mr. Thomas Trammell came outside with his gun loaded and the dogs started to run back home and instead of firing a warning shot or yelling at the dogs to get out of his yard Mr. Thomas Trammell just shot at my dogs with a 410 shot gun. Chloe came home with some remnants of the first shot starting from her rear up her right side. Sophie was wounded enough that she couldn't run away so Mr. Thomas Trammell aimed and shot her two more times to kill her.

I have raised dogs all my life and did not know that there is a major vein in a dogs back leg that will make them bleed out and die. Mr. Trammell did not shoot at Sophie's head, he shot her in the back leg. He knew that shooting her in the back leg would kill her.

My dogs had on collars with dog tags that had our name and telephone number on it. Mr. Trammell was caught by my husband dragging Sophie off by her back legs. Mr. Trammell did not even look at her collar to see who she belonged to. My husband asked him why didn't he fire a warning shot and the answer was "that doesn't work". When my husband asked him why he shot Sophie, Mr. Trammell said because my dog was trying to get at his dog through the fence...Yet Mr. Trammell told the Sheriff that my dog was on his fence keeping him from leaving his fenced in yard.

We need the DA to prosecute according to Penal Code Sec. 42.092http://www.statutes.legis.state.tx.us/SOTWDocs/PE/htm/PE.42.htm
