08-2008 Freshman year at Huntsville High School for John.

09-2008 John and Anna (Sophomore) begin dating.

10-2008 John and Anna are suspended from school for kissing.

11-2008 John, is suspended for kissing Anna, he asks that they do not suspend her.

01-2009 John and Anna are suspended for kissing.

02-2009 John, is suspended for kissing with Anna, he asks that they do not suspend her.

12-2009 John and Anna were still dating, but keeping their affections for each other private. In December, 2009 Anna started dating another boy that attended a different High School.

04-2010 Anna, files a report accusing John, of trying to have sex with her in the school. This report is completely slanted, as the officer left the report open instead of completing the report writing where Anna, admitted she lied to get John, in trouble. Police Officer Charity Roe.

04-16-2010 John is suspended along with Anna for kissing.

05-21-2010 By the end of the school year John, has a broken heart and is tormented by Anna.

06-2010 John has been messaging back and forth with a girl named Miranda. Reluctant to meet with her because she is 14 years and 7 months old and he is 17 years 9 months old. He meets with Miranda and asks for permission from Miranda's mother to date Miranda. Permission is granted.

07-22-2010 John and Miranda have consensual sexual intercourse; however, Miranda isn't old enough to give consent. (This took place at Miranda's' Grandmother's home.)

07-25-2010 I pick up John from Miranda's' grandmothers home shared by her Aunt Rochelle Moore, and her cousins Mya, 10 years old and Mya's brother Ty.

07-26-2010 John had been caring for his nieces Lilly, (7 years old) and Jasmine, (5 years old) at Stephanie's, (John's older sister) home in New Hope, AL. Which is located about 45 minutes from Huntsville, AL. That evening John tries to contact Miranda, by phone and is told that she is missing. Then John receives a threatening call from a man he doesn't recognize his voice or phone number.

07-28-2010 Three unmarked cars drive into my daughter's home and surround the house banging on the front and back doors of the home. Lilly and Jasmine hide. John grabs a hammer for protection and opens the front door. He recognizes officer Roe, and puts the hammer down, the officers open both front and back doors as officer Roe, shoves John's head into the wall, while she handcuffed him. Officer Roe, phones my daughter Stephanie Baker, and told her to come and take charge of her children. I received a phone call to meedt officer Roe, at the Children's Advocacy Center in Huntsville, AL as they are detaining my son and could not tell me anything further over the phone. I arrived at the Advocacy Center at approximately 1:30 p.m. or 2:00 p.m. John, who had requested that I be present and or an attorney had neither in the room where he was being aggressively interrogated by officer Roe. He had not been read his Miranda rights and was refused Parent and legal counsel. John is arrested and charged with Sodomy in the 1st of a child under the age of 12 and Rape in the 2nd involving Miranda. He is taken to Jail.

08-02-2010 I am able to post bond and John is released.

08-09-2010 First day of John's, Junior year of High School.

09-08-2010 First meeting with court appointed attorney Roy Miller.

09-10-2010 John's 18th birthday.

03-01-2011 Miranda sends a Facebook apology for her cousin (Mya) lying.

03-09-2011 John sees the Facebook apology, calls Roy Miller, who advises John to respond to the Facebook apology. (snap shot of the Facebook apology is taken and later entered in as evidence.)

03-11-2011 Youthful Offender Hearing. Denied Y.O. pending DNA results.

03-21-2011 Court ordered to give saliva swab test, officer Roe claimed John refused to give saliva. (Clearly in the videotaped interrogation officer Roe collected the saliva swab from John.)

09-28-2012 DNA results received. Report states: absent of blood. Absent of semen.

01-29-2013 Arraignment-continued. John was offered a "plea deal". If he agrees to serve one year in jail, they will implement the Y. O. status and he can walk away. John was not raised to admit guilt to something he didn't do. He refuses this "plea deal". Where Roy Miller states, "the truth doesn't matter, it's what you can prove in a court of law."

03-18-2013 From 03-12-2013 this week was focused on John accepting the "plea deal" spend 1 year in jail, then he could "walk away." He did not do what they accused him of doing and refused to accept the "plea deal". Trial begins by appointing the jurors who will hear the case.

03-20-2013 Shortly after 9:00 a.m. Jury convicts John of a "lesser" charge that still carries a minimum mandatory 10 year sentence. John is arrested and taken into custody without bond.

05-10-2013 Sentenced to 10 years, no good time, DNA is distributed to the national data base and John will have to register as a sex offender for the rest of his life. Appeal filed and Roy Miller withdraws himself as attorney.

05-2013 Court appointed attorney for the appeal, Cecilia Pope. She tries to show that the courts abused their discretion, and denied John (who had never been in trouble before) Youthful Offender.

12-06-2013 Appeal is denied. They did not find an abuse of discretion. I am trying to collect the funds necessary for the Rule 32 application/process. John needs an attorney that his family pays for and is not paid by the State of Alabama.
