Currently in most states, no law exists to punish prosecutors civilly or criminally (due to immunity protection) when they violate a defendant’s due process rights including but not limited to; withholding exculpatory evidence, not testing and destroying evidence along with the use of unreliable so called “jail house snitches” who are used to taint a jury from hearing the truth and seeing the real evidence. Most of the jail house snitches were coerced and suborned by the prosecutor to strengthen their case against the defendant due to their case being so weak to begin with. After these people lie on the witness stand they either receive a reduced sentence or they forego jail time all together which incentivizes them to lie. If they have vital information to offer at trial they should be given nothing in return which would make it much more plausible that they be truthful when testifying and doing it for the right reasons.

The state bar associations don’t take complaints seriously enough and dismiss them without a full investigation into a defendants or their family’s allegations.

By asking the Governor to create a committee to oversee and investigate prosecutors will ensure that they are following the law of due process that they swore to uphold when you voted them into office. Once an allegation is investigated and proved to have merit, the prosecutor would be held “criminally liable for a charge of obstruction of justice” and other charges the committee would deem appropriate. The prosecutor would also be held civilly financially liable for persons who have been incarcerated from their due process violations.

By having this committee in place to hold prosecutors accountable will hopefully make them think twice about using such deplorable tactics as described above to win a case and as a result taking years of a person’s life. Many of those defendants sent to prison for decades, some are sitting on death row and several are already executed.

I implore you to please sign this petition and be a part of something larger than yourself to help stop the injustice that has gone on far too long in our country. One day you could be living a good life, working hard, raising a family and in minutes you become a statistic. Don’t become one as I did.
