North Carolina as well as several other states in the Country have grown weary of bogus malpractice law suites. However, there are many more cases that are extremely ligitimate. Senate Bill 33 in NC has made it nearly impossible for Doctors, Hospitals and Nursing Care Facilities to be held accountable for mis-diagnosis, abuse and Medicare fraud by creating untrue medical conditions. This is ever present in the elderly and cases where the families are completely trusting of the situation created by these "care-givers". This new Senate Bill reads as follows: "A BILL TO BE ENTITLED...AN ACT TO REFORM THE LAWS RELATING TO MEDICAL LIABILITY BY PROVIDING LIMITED PROTECTION FROM LIABILITY TO THOSE PROVIDING EMERGENCY MEDICAL CARE, BY AUTHORIZING THE BIFURCATION OF TRIALS ON ISSUES OF LIABILITY AND DAMAGES IN CERTAIN ACTIONS, BY LIMITING THE AMOUNT OF NONECONOMIC DAMAGES THAT MAY BE AWARDED, BY AUTHORIZING THE PERIODIC PAYMENT OF FUTURE ECONOMIC DAMAGES IN LIEU OF A LUMP SUM PAYMENT, AND BY MODIFYING APPEAL BONDS IN MEDICAL MALPRACTICE ACTIONS." In other words, if you have been mis-diagnosed, treated unfairly, abused, etc., it will cost you thousands of dollars in Attorneys' fees, and you may never win in Court. Even if you can prove your case. Doctors, Hospitals and Nursing Facilities can literally get away with anything because they know they will never be sued.
