BE IT ENACTED BY THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES OF AMERICA IN CONGRESS ASSEMBLED.

Preamble: Whereas police brutality is an issue throughout the United States of America, there must be an Act to prevent and protect all citizens/ex-offenders from excessive force by law enforcement officers when being apprehended in all states. The Hands Up Act shall give every U.S. citizen/ex-offender the right to not be apprehended with excessive force. Establishing that if any law enforcement officer suspects’ hands are up over his or her head upon apprehension, than it shall be a federal crime if any law enforcement officer uses excessive force, shoots or kills the suspect or suspects that were being apprehended by the officer.

SECTION 1: Let the definition of police brutality be the use of excessive force, shooting, or killing a suspect upon apprehension when the suspects’ hands are up over his or her head.

SECTION 2: Let police brutality, as defined in SECTION 1, and law enforcement officers who act out police brutality when a suspects’ hands are up be charged in a federal court for his or her crime of police brutality.

SECTION 3: Let all citizens/ex-offenders receive equal opportunity, privilege and right to the Hands Up Act.

SECTION 4: This bill shall go into effect 60 days after passage.
