My proposal - Short & simple unlike our 4000+ page bills congress does not read.

Proposal: 1(a) If any American citizen in the past has committed a misdemeanor or felony in which currently prevents federal gun ownership through the NICS and ATF background firearm check and the felony is expunged by the judge/court the citizens record needs to be removed from their criminal record not only for firearm qualification purposes through the NICS background check, but also to be removed for an ability to apply for and have an opportunity at middle to higher end jobs that employers desperately need, but candidates are being turned down because their expunged records that should no longer exist on a criminal background check are not being removed from that American citizens record. 

1(b) The American citizen in which the American citizen has paid for and filed for expungement and the court entered a not guilty plea for the initial matter and dismisses the case then that American citizen be allowed to purchase a firearm. Specifically for cases involving non weapons for the current federally prohibitive criteria under Title 18, United States Code, Sections 921 (a) (20) and 922 (g) (1) : A Person who has been convicted in any court of a crime punishable by imprisonment for a term exceeding one year or any state offense classified by the state as a misdemeanor and is punishable by imprisonment of more than two years.

**Quick explanation of how this law discriminates against potential employers with qualified candidates seeking opportunities to succeed in American business and law abiding American citizens that made a mistake when they were young in their past. The current law discriminates against American citizens who had made a mistake in their past and everyone deserves a second chance especially if their criminal record was expunged by the court system.

Here is the the other part that discriminates against employment and gun ownership.

What this means is that you may not have ever served a day in jail, or significantly less time than the maximum penalty, however if there was a "maximum penalty" in the case of one or two years possible of imprisonment under federal law you still are not allowed to purchase a firearm or have any opportunity at a good job. Under current law the federal government does not allow this as the law currently hides behind the "maximum penalty rule"; under the above penal code listed, the federal government overrides state law and bases it's decisions not on what happened in your case but on what the maximum punishment for the offense is.

I also believe in second chances just as we have given our government and political officials many second chances as the American citizens they are.

1(c) I also believe in second chances for American citizens in which their record was not expunged; if that American citizen has not committed any criminal offense for the period of 10 years following the mark on their criminal record, that American citizen should be allowed the opportunity to have his record removed from background checks and be given an opportunity for quality employment and an opportunity to purchase a firearm.
