Capacity for rehabilitation: -Non- Violent Crime -Mentally stable -First time state charge Personal progress before incarceration: Starting and successfully running two businesses, Self teaching photography, learning framing carpentry, attending Lincoln tech for auto mechanics, and passing the GMAC among many others. Insufficient Counsel: Sean’s original attorney failed to give him his complete discovery package stating that he didn’t get the whole thing because there were a lot of copies of the same thing. He was not shown any evidence (i.e. copies of forged documents) or a witness list. The attorney failed to properly explain what the state had to prove regarding the documents. Sean later found out that the state had to prove intent. The attorney also failed to inform Sean that his co-defendant could have been discredited as a witness against him. All of this plus the fact that he was given 10 minutes to make a decision by his attorney and his obvious agitation made him feel obligated to take the plea. It was his attorney’s job to properly inform him. Sean’s second attorney represented him at his VOP (Violation of Parole) hearing. After Sean was sentenced he asked the attorney if the judge would later reconsider. The attorney said that he highly doubts it. Then Sean asked about a three judge panel because his co-defendant was released after 6 months by a three judge panel. The attorney said he would file it. When the attorney filed a motion it was for sentence reconsideration not a three judge panel review. It is now too late to file for the three judge panel review and Sean has been denied parole leaving him with no sentence relief options. I along with those that have signed this petition, feel that a release from further incarceration or a new trial are better options in Sean’s case, given the circumstances.
