First, let me say I am sorry for your loss. I am in total agreement with you about the laws for DWI's resulting in death of innocent people.The automobile can be a dangerous weapon when used inappropriately. Like any other crime there is an Actus Reus and a Mens Rea to establish a murder conviction in a DWI homicide. I believe, more people would think twice before getting into a vehicle while impaired if, they knew that they may spend the rest of their lives in prison if they kill someone(s). The laws are too lenient on DWI-big deal they take their license-most of them will drive without it. I say, first time go to jail for the minimum of a year because while they are in jail they can get some counseling for their problem whether it be drugs or alcohol and learn about the possible consequences of their irresponsible actions. Second offense, minimum 5 years and repeat programming, third offense life they have no respect for the law or life.These should be mandatory sentences for DWI's without a homicide. |
