Child custody appeal petition on behalf of Gage Dylan Kociolek where mother, Kyrie A. Norris requests that the court review the statement of facts regarding Gage's diabetes management, academic progress, positive social and spiritual structure and stability where he has resided since his birth August 23, 2005 with mother and grandparents. Following relocation back to Pennsylvania with mother and grandmother it appeared in the best interest of Gage that he temporarily reside with father, Jason J. Kociolek and grandmother Michele A. Axelsen that Gage finish Kindergarten school year and father learn diabetes management care. The arrangement with his father Jason J. Kociolek since May 2011 has proven to be unsuccessful where numerous domestic disturbance calls involving Freemansburg police intervention at Jason's apartment, alcohol related domestic violence occurrences against Gage's mother, Kyrie A. Norris, grandmother Michele A. Axelsen and grandfather Randall J. Axelsen and has experienced verbal outburst with school administration, excessive partying at apartment while Gage is present. Jason has been in arrears of child support since Gage's birth paying only upon his incarceration and has borrowed money against a pending lawsuit to pay rent on his apartment. Jason is unable to work due to difficulty locating a medically trained affordable day care for Gage. Mother and grandmother are available to continue to provide Gage's ongoing care and support and are capable to paying rent successfully as having supported Gage together without financial assistance from Gage's father.
