The petition
Charles C. Thao and Mai Lor, husband and wife, was indicted by federal grand jury in the WESTERN DISTRICT COURT OF MISSOURI. The indictment accused them on the ground of CONSPIRACY TO DEFRAUD THE UNITED STATES CONSUMER; CAUSING INTRO OF UNAPPROVED NEW DRUGS INTO THE UNITED STATES; ADULTERATION OF DRUGS; INTERSTATE COMMERCE VIOLATION; CONSPIRACY TO DEFRAUD U.S, FRAUD BY WIRE, FRAUD BY WIRE; CONSPIRACY TO DEFRAUD U.S; FRAUDS AND SWINDLES; AND CONSPIRACY TO COMMIT MONEY LAUNDERING. They were arrested on Thursday, February 28, 2008, 8:30am in their residence. The arrest was carried out by FDA agent, Todd Blair and his special agents. Thao and Lor were very cooperative with the agents during the arrest. They were released on signature bond and put on home confinement awaiting trial.
We, the consumer and community would like to beg the court and/or the honorable judge to consider the fact that these two individuals are not dangerous to the community or society. They are simply the wholesaler of an approved and natural substance, DIETARY SUPPLEMENT. It is clearly not a drug. According to the indictment there has been no consumer complaint filed against them; no injury occur; no death occur; and no government agencies, including the FOOD AND DRUGS ADMINISTRATION (FDA) and/or FEDERAL TRADE COMMISSIONS (FTC) had ever sent them a COMPLAINT; WARNING; or ADVISE of any kind. We all have taken the products and the results were satisfaction. Our purchased were guaranteed by their distributor, Techmedica Health, Inc.. There are no side effects or adverse reaction reported. The product is reasonably safe and effective. We bought the product base on its effectiveness, not because who made it or sold it.
We do not believe that these two individuals have committed the alleged offense to that extend. The Thao and Lor are good people. They have serve the community; very active in their church; and contributed services to the community. They have no criminal background. Their faith, their kindness and humbleness is an example to us all. Therefore, we beg the court, the jury, and the prosecutor not to send these two DEFENDENTS to prison, if convicted. It is more favorable to the government to confine or restricted them in the home, to perform community service, or put on probation. We ask the court to have mercy for the Thao and Lor. They have done nothing to hurt anyone in the past or present. Regardless of the evident against them, we have no doubt that these two individuals had anything to do with the crime committed by someone else. We ask for your mercy, justice and fairness.
