We the people of the State of Mississippi desire amendments be made to the law in regard to its antiquated divorce statutes. Mississippi Law requires that, in order to obtain a divorce on grounds other than irreconcilable differences where both parties agree, that one of the following must be proved: Mississippi recognizes seven fault grounds based on one spouse's inappropriate conduct. They are when a wife being pregnant by a man who is not her husband, adultery, one spouse's intentional abandonment for at least one continuous year, one spouse's incarceration in a federal or state prison, "cruel and inhuman treatment," including physical and emotional abuse, continuous alcohol use and continuous drug use. Cruel and inhuman treatment is among the hardest to prove as it's been established that most cruelty occurs inside the home where there are no witnesses. If the client cannot prove this treatment, then a divorce is not granted forcing the person being abused to remain married to the abuser. This is barbaric and antiquated. The law, as it stands, allows a person who is emotionally abusing another, to essentially hold them hostage and not allow them out of the marriage thus continuing a pattern of abuse and control. Now it is 2012. This law should be amended forthwith. It is time to update this law to reflect modern times when it happens that two people just aren't compatible, but one isn't forced to remain married. Mississippi, for example, has no legal separation. It can take a year or more for a divorce to even be heard while during that time spouses have no recourse to get away from the other. They cannot buy a house without the signature of the other spouse if a divorce is not granted. Anything financial must have the other spouses signature. This makes absolutely NO sense. Please sign so we can let Mississippi Lawmakers know it's time to come out of the 1800's and give options to those who currently have none.
