August 14, 2013 New terms to our custody agreement with Jeremias Hernandez and Cindy Medina Cindy and I, Jeremias Hernandez decided to agree amongst ourselves for our custody agreement for our daughter Celia Isabell Hernandez. Custody Cindy Medina has 50% custody and I, Jeremias Hernandez will have 50% custody of Celia Isabell Hernandez. Only Cindy Medina and I will make any decisions regarding health, education and welfare over Celia. Physical custody Per Contra Costa County, I, Jeremias will have physical custody of Celia because she will be with me the majority of time and by law it is considered that he will have physical custody. Visitation Cindy Medina and I have come to an agreement that Celia Isabell Hernandez will be attending school in San Francisco, CA. I, Jeremias will have his visitation/custody Monday 8:30am to Friday 7:00pm. Cindy will drop off Celia on Monday's at 8:30am at Sanchez Elementry School 325 Sanchez Street, San Francisco, CA, 94114 I, Jeremias will drop off Celia at Cindy's apartment at 645 Berk Ave Apt 11 Richmond, CA Fridays at 7:00pm If times or days need to be changed both parties will communicate accordingly. Weekends ONE WEEKEND A MONTH TO JERRY Cindy and i have come to the agreement that Celia will stay with me one weekend a month. It will be a random weekend, no set week and make sure it works with Cindy. I will ask with time in advance, and will understand if Cindy has plans but I am entitled to one weekend a month. If i would like another weekend in the month, I will ask Cindy and I agree to be patient and understanding if she cannot comply with my requests. Summer Time visitation/Custody Celia will be partaking in extra curricular activities during the summer. Summer programs where it may be required for her to attend the full 5 days of the week which needs to be discussed between Cindy and I when the situation arises since it is a possibility so the hours will stay the same as the school year if that is what the programs demand. This is something we can come back to when the time comes, no rush for the summer schedule. For now, Cindy and I have come to an agreement when the Summer time comes, we will go back to the schedule we currently have which is: Jerry: Monday 12:30pm to Friday 8:00pm Cindy: Friday 8:00pm to Monday 12:30pm Cindy also has the option of possibly keeping Celia for a full week (10 Days) in the Summer since she may have plans with Celia. Cindy and I have agreed she will let me know two weeks (2) in advanced for the extra time she might want. I ask for Cindy to ask, communicate and negotiate with me when shes thinking about spending more time with Celia during my time and agrees to be patient and understanding if I cannot comply with her requests. I also agree to ask, communicate and negotiate with Cindy if I would like to spend more time with Celia during Cindy's time and I agree to be patient and understanding if she cannot comply with my requests. Holidays When there is a holiday on a Monday, Cindy will drop Celia off to me no later than 12:30pm at the BART station we currently meet. EVEN YEARS WITH JERRY, ODD YEARS WITH CINDY Cindy and I have realized that the current court order has a few confusing clauses. Here are the holidays as followed: 1. Thanksgiving: Odd years with Cindy, Even years with Jerry Odd Years: Pick up at 6:00pm so I can have lunch with Celia before she spends Thanksgiving Dinner with Cindy -If hours need to be adjusted on this day it can be discussed between us on or before that day. Even Years: Since Celia is in my custody on Thursday and I keep Celia on even years for Thanksgiving dinner, I will drop off Celia on the following Friday at 8:00pm -If hours need to be adjusted on this day it can be discussed between us on or before that day. Example for the next 6 years -If hours need to be adjusted on this day it can be discussed between us on or before that day. However if we cannot come to an agreement, the hours and days will remain as: 2013: Cindy: Pick up at 6:00pm 2014: Jerry: Drop off Friday 8:00pm 2015: Cindy: Pick up at 6:00pm 2016: Jerry: Drop off Friday 8:00pm 2017: Cindy: Pick up at 6:00pm 2018: Jerry: Drop off Friday 8:00pm 2. Christmas: I have Celia Christmas Eve every year, and Cindy has her Christmas day. We have had no issues, I want to continue this always. I'm open to changing or switching the day if Cindy has plans or something on that day- We switched Christmas 2012 and it was fine. 3. New Years: I have Celia every year on New Years Eve and I drop off Celia on New Years Day to Cindy. We have had no issues, I want to continue this always. Transportation NO ONE UNDER THE AGE OF 25 IS DRIVING CELIA NO ONE under the age of 25 is to drive my daughter Celia. I expect Celia to be driven by a careful, insured, responsible, licensed driver. After one year (1) Nancy Medina who is Cindy's sister will be allowed to drive Celia. Nancy is 18 years old, doesn't have much experience in driving which is my biggest fear and concern. Cindy and I have agreed that Nancy Medina will wait 1 year from this date to drive Celia. IF Nancy is in any way involved in an accident, speeding or any moving violations this agreement is over and she will no longer nor anyone under the age of 25 drive Celia with he exception of Cindy since she is Celia's mother. After the 1 year if Nancy has proven she is responsible I will consider her to drive my daughter in Richmond. No freeways, not across the the bridge to San Francisco or anywhere out of the State of California. Trips out of County and out of State NO OUT OF COUNTY & STATE TRIPS I have no issues with them wanting to spend time with my daughter but when these trips are out of the state and without my consent, it becomes a problem since it clearly states in our current court order WE ARE NOT TO LEAVE THE COUNTY NOR STATE. All I ask is for Cindy to attend any out of state trip which she has to request from me by law. If she is not able to attend she needs to let me know by law and we can figure out a solution. If I would like to take Celia out of state I also request Cindy's permission as well. I will also attend those trips, if i cannot i will let Cindy know and figure out a solution. Hair and Hygiene NO ONE is to CUT, TRIM, DYE, CUT, CHANGE CELIA'S HAIR BESIDES JERRY Cindy and I have discussed hygiene and maintenance of Celia's hair. I would be the one to get her bangs and hair trimmed and no one else. Cindy and I have agreed to this because I have a professional that i take Celia to every 2-3 weeks. I will be responsible in making sure Celia's hair is trimmed, no major changes unless it is agreed by Cindy and I. No dying until she is 18. Uniforms are a possibility, which I will provide. All I ask is for Cindy to return all the clothes I provide. I ask for Celia to be bathed, hair ready and all of her school supplies ready for school on Monday mornings. I ask Cindy to be responsible and to make sure Celia is bringing back everything she may take to Richmond on Fridays after school. To be respectful of Celia's belongings to avoid a miscommunication. Clean clothes and making sure Celia is bathed. No dark nail polish. Light glitters or very light colors are OK since nail polish is already damaging to the nail. Trimmed nails, clean nails as well. It's important to teach responsibility and cleanliness for school. I will be checking weekly attendance to make sure my daughter is not late to school on Mondays, if she is consistently late, I will request Celia be dropped off to me on Sunday nights. I am willing to work with Cindy and if she needs to drop off Celia occasionally on Sundays because of car problems, work early or any other reason, that is perfectly fine I have no problem helping Relationships NO ROMANTIC RELATIONSHIPS UNTIL CELIA IS 17 Although it's very early to bring up, I cannot stress enough my fears for my daughter but my hopes are bigger. I want my daughter to learn from her parents and understand life is hard, everything has its time. While she is under aged i will not allow any boyfriends or romantic relationships of any kind. No relationships until she's 17 years old. I am willing to understand and meet certain people my daughter would like to be involved in but as her mother and I made a few mistakes she is a result of a teen pregnancy. I do not want that for my daughter, im thinking about her future and her well being. I do not want her hiding anything from me and I don't know if I can trust Cindy in the future being on the same page as me. I want Celia to go to College, I am saving for her college fund and want to give her a better life. There are too many cases of teen aged pregnancies, we know first hand. Lying and Hiding NO COACHING LYING OR HIDING No one is allowed to coach lying to Celia whatsoever. Only Cindy and I are her parents and we are the only one to make decisions. We welcome opinions and ideas as well but the last and final decision is made by us. We want to create a loving and solid family for Celia between Cindy and I as well as our families and friends. We will be productive and peaceful manner which create and bond for Celia. We also have agreed to discipline Celia together and discipline her accordingly. We have agreed to communicate any serious matters and involve each other when either one of us disciplining Celia. We want Celia to know we're a team of parents and nothing will be hidden from either parent. Taxes Cindy and I have agreed that I will claim Celia on my tax returns every year. I will be responsible to buy her all her school supplies, school clothes, shoes and accesories. We more than welcome any contribution from Cundy if she'd like but I will be soley responsible for her school needs.
