Petition for the termination of Bal Harbour Village Manager Alfred Treppeda for unethical conduct regarding failure to protect public beach access.
Whereas, the inadequate and un-equitable policy of beach access in Bal Harbour, FL over the past four years has been detrimental to the public good and in violation of the terms to the Miami-Dade County Beach Erosion Control and Hurricane Protection agreement with the United States Government; and
Whereas, Florida Governor Charlie Crist has declared With more than a thousand miles of sandy beaches in Florida, it is vital we make it accessible to all residents and tourists\"; and
Whereas, the Florida Supreme Court has opined, No part of Florida is more exclusively hers, nor properly utilized by her people than her beaches. And the right of the public of access to and enjoyment of Floridas oceans and beaches has long been recognized by this court; and
Whereas, public records show Bal Harbour Village Manager Alfred Treppeda ignored a Florida agencys certified letter directing him not to limit public access to State owned property utilized for accessing the beach; and
Whereas, public records show that when State personnel contacted Village Manager Treppeda, noting a proposed agreement to allow private enterprises utilization of State property was contrary to State policy; Village Manager Treppeda failed to disclose that he had already signed and executed said agreement; and
Whereas, Village parking revenue ledgers document the receipt of over $300,000 for usage of State land in relation to the agreement that State personnel had deemed contrary to public policy; and
Whereas, public records show Village Manager Treppeda attempted to curry favor with State personnel by using the name of the Villages hired lobbyist, Ron Book, after receiving a certified letter of eviction and demand of monies collected regarding improper usage of State property; and
Whereas, after receiving the certified letter of eviction and demand of monies, Village Manager Treppeda stated to Channel 7 News-Miami on February 2nd, 2008, it was a legal agreement that compensated us for our loss in parking meter revenue;
Therefore, we the undersigned find Bal Harbour Village Manager Alfred Treppedas conduct to promote the inadequate and un-equitable policy of beach access in Bal Harbour, FL unethical and unbecoming of the duty and character necessary for public service.
We call upon the Village of Bal Harbour to terminate Village Manager Treppedas service and surrender to appropriate State agencies all funds related to his unethical conduct.
We also call upon Miami-Dade County and the State of Florida to protect the fishermen, surfers, divers, beachgoers and general public by immediately restoring and henceforth maintaining public parking and beach access in Bal Harbour Village, FL.
