2 Ron MurrayHOAs generally have more authority than do governments. States get around that by requiring purchasers of property that has deed reqtrictions and an associated POA to agree that, by virtue of the purchase, they have a contract with the POA. There is no other purchase that has such a requirement and any purchase that requires agreeing to a contract with a third party certainly must be unconstitutional. Because POAs have the authority to place liens on property, they have the ability to sieze property without even the minimal requirements that governmental jurisdictions require.

There is no longer such a thing as "WE THE PEOPLE" as long as they are allowed to remain in existence. We need to unite against and fight our governmental officals who vote for these dictatorship entities to be in power.
4 John C. Collier, Jr.HUD administers the cover law to allow this kind of discrimination where people younger than 55 can be omitted. The regulating body under HUD is HOPA. Much of what HOA's do is discrimanatory in that only 80% occupancy is required and eviction is prohibibted. However, no one seems able to or wants to enforce these Federal regulations.

6 Christina L. YanksonLiving in an h.o.a. is liken to being a child again. Mom & Dad are the last word in everything, (@ least they were when I was a child). It is likened to being in the military, where you are also tightly controlled. Those days & times behind me, now I face a new "controlling institution". I believe your home, which you pay for, "the place you should have control over", shouldn't be encumbered w/needless, ever endless rules & regs & I shouldn't have have to ask permission for almost everything I do to the exterior of my property! I have been very involved in my communities' h.o.a., as a "watchdog" to try to help keep them honest & not as controlling, but I do hate the very idea of being controlled on my own property. I know it's all just another way of sucking money out of folks. I say, "Yes, STOP the madness!!!
7 R W CraigWhat is a Democracy, and how do HOAs compare to democracy? More like a dictatorship, isn't it? There was never a signature on a petition to form any of these MAFIA (Mandatory associations foreclosing in America). Put it to a vote - renew the Corporate charter by petition only. Require 51% to extend, renew or create the annual "contract". Anything less if fraud, racketeering, facist and criminal on several levels. Justification to use deadly force includes the Castle maxim doctrine (or something like that), passed in Texas 2007, giving wider latitude to shoot thieves and robbers on sight. I've long preferred the castle doctrine of Scotland - circa 1066, when Swords and sharp sticks served justice. Welcome to Texas, land of free will and decendants from Scotts and other free men. FREEDOM FROM LANDLORDS must be restored to this society. Put it to a vote. What are you, afraid?

10 cathy alexanderwe were not informed of a hoa in our neighborhood, and now we are forced to pay 100 each year. and never had the rules sent to us. We cant even park our trailer my husband uses for work on our lot, we have had a lien slapped on us too. We are in prison in our home.

12 DonnaAyalaI am against all types of mandatory associations. I agree with this court's opinion: "The constitutionally guaranteed freedom of association includes the freedom not to associate. The right to choose with whom one will associate oneself is the very foundation and essence of that partnership. It should be noted that the provision guarantees the right to form an association. It does not include the right to compel others to form or join one."

14 Shawn McGuyerOften, tyrannical boards dominate the associations, and harm the property owners. Often, no oversight function is available over these boards, and property owners are forced to file expensive lawsuits to obtain relief from the tryanny.
15 AnonymousOur 1999-2004 built subdivision's property values have not kept up with area values. Reason? Local realtors will tell us that our Nazi-like Homeowner's Association is the reason why! Their reputation is common knowledge. so by their repressive measures - they have brought about the very thing they seek to prevent - lower property values in an other- wise very nice and growing area!

17 Lisa HarrisI have been made to feel like a prisoner in my own home! I have NO rights on my own property. Not only do I pay a mortgage, Homeowners insurance & Property taxes but I am also FORCED to pay homeowners dues. I am tired of someone literally dictating to me what I cannot do on my own property. People should not have to be subjected to unreasonable regulations & harassment . Once again an example of American citizens having NO rights!

24 Koreen KrugerWe do research to assist "homeowners" in mandatory HOAs. Find out who really runs your HOA board, where they really live, and how many HOA liens and HOA foreclosures have been recorded by your HOA. We also can locate your recorded CC&Rs.
25 AnonymousIt boggles the mind that Federal and State governments have YET to protect American homeowners by stepping in and properly REGULATING these out of control HOAs. We will be looking for a new home soon and my wife and I will be adamant with our agent that we will have nothing to do with neighborhoods with mandatory HOA membership (which includes just about all of the new construction in our area). We've heard far too many bad things about HOAs and we refuse to put ourselves in such a vulnerable position. In my opinion HOAs completely go against the "American way."
26 Dawn KubI am totally against HOAs in any form so if you have any petitions that deal with removing them or at least taking away their power, I would be happy to sign those petitions.
27 judyI have lived in four different situations which involved an association and I have found each time that they is nothing but trouble. You can't live in your own home with out some busy body with nothing to do watching you and raising the HOA fee. The worst thing is that you are getting nothing for your money.

30 Jennifer MontrossThis is a horrible thing that is happening in our country. Our children deserve to carve thier own paths in life, and commercial activities should not be limited by non-sense zoning restrictions etc. based on the opinions of fussy retirees and the like.
31 RajH.O.A's are a nightmare. I abide by all thier stupid rules, I pay my fee every month and when i have an issue there is no one to talk to because they avoid you. And there seems like there is nothing legal you can do, it is so frusrating. I advise anyone who is buying a house, stay away from any H.O.A's.
