| 19 | Antonio Ferreira | Today I filed/emailed a formal complaint against the manager of a local store in MA, as the representative of ATT for flagrant misrepresentation and fraud committed on my account, and against me.
On or about 3/6/2008, I reviewed my account online after receiving an automated email "thanking" me for choosing ATT. I then saw that one of the lines had been removed from the group plan, and altered to an individual plan...???.... This did not make sense since my plan was superior than the 'changed' plan.
I did not authorize, nor was I even contacted in any way to have my service changed. Not only was the entire package changed on my 8233 number but certain previous services had been removed. Additionally, I noticed that other services only on that line had been removed to another line on the account as well. Therefore, various lines were 'violated'.
Previously, I had complained about issues with calls, etc. Their CS instructed me to request a replacement SIM card -- a SIM swap -- for 8233 at any local store because that card was failing. I instructed the person using that phone to go into any local store in MA and request the SIM swap as indicated by the AT&T phone rep to me. He was given a card by the store manager who replaced it directly. THAT was the extent of the conversation. That was the extent of the request!
Why was my service later, or then, changed? Not merely changed but 'cancelled' and NEW service set up???? How is it possible to have an agent in a company simply go into someone's account, change it at the agent's personal will and whim, and NOT even notify the owner of the account? I was taken from a better plan to an inferior, and more expensive plan.
There was absolutely no disclosure. There was no signature. Certainly no calls to me. Nothing. All those changes, when ALL that was requested was a SIM swap.
Again, without any regard for my wishes or even the opportunity to notification, a company rep. and stranger arbitrarily decides and performs changes on someone else's account. Worse still, the company then states they canNOT correct their error nor change the service back!!!
After seeing this apparent illegal and fraudulent action -- this blatant total disregard for my privacy and my freedom of choice, I immediately called their customer service, and spoke to a Supervisor on duty. Over the period of a few days she helped as much as possible to "correct " my plans by way of '$ credit' on the account. However, that only means once the 'credit' runs out ( a few months) I will be paying for service I did not request. And needless to say, she did not have the authority to reinstate my account to its previous service levels, nor was it possible to get anyone who could. An while the 'credit' would be applied to the account, no written communication could be sent to confirm this.
When I filed my complaint to AT&T, I requested that the store manager responsible for these deceptive business practices be brought up on disciplinary charges. I also asked for written contact from the regional manager of the area where that store is located. Additionally, I asked about the corrective and preventive measures AT&T would be taking to prevent such account violations and illegal business practices in the future.

However, started noticing I was getting a bill every month charging me for local and long distance and internet access. So I called them to complain, they said they didn't disconnect me, and that it was a repair request, and they sent someone out to fix the problem. He came back saying it was disconnected from the outside. Still working on trying to reduce my bill with them. |

I made no calls out but was charged absorbant charges for never making a single call out. I paid AOL charges so it didn't make sense why bills were over 75 and up dollar a month! They also ripped off my father who was a senior citizen and charged him for landline he never got when he moved to a new residence. We had to fight to get his money back also. And we did. I was told this would cost $25 per month and no mention was made of any other charges. Upon receipt of my first bill for $142, I was floored. Included in this excessive bill was a $65 activation fee for switching my service to AT&T. WHAT??
I was NEVER told that there would be a fee of any kind for the privilege of doing business with AT&T. Under no circumstances would I ever agree to pay for granting my business to any company. If AT&T wants my business and my money, they can damned well pay me $65.00. Just because one of AT&T’s employees in a third-world country checked a box indicating that he told me of the activation fee is in no way conclusive that said information was ever imparted and I assure you, it was not!
AT&T saw fit to ignore the rules of good customer service and to not give me the benefit of the doubt but instead chose to believe their infallible employee (I didn’t know the Pope worked for AT&T) and turned the $65.00 unpaid bill over for collection. I put a stop to the collection procedure via the Fair Credit Billing Act, which, under the law, requires them to provide proof that I owe said amount either through voice recording (the way Verizon does it) or by written agreement. The word of their employee from India against mine is not proof and therefore not acceptable. The collection process was forthwith stopped dead in its tracks. Needless to say, should there be any harm to my credit standing as a result of AT&T’s attempt to collect a bill that I do not owe, will definitely result in litigation. Said litigation will be for the grievous mental anguish and suffering and undue harm wrought upon me and my family, and also for the harm to my credit rating, all of which is dischargeable in a civil court for damages. Lawyers love deep pockets!
When I discovered, after the fact, that I was being charged $65.00 to do business with AT&T I promptly cancelled the service with them and switched back to Verizon. Verizon, who charges $35.00 for their connection fee, recorded our conversation wherein they advised me of exactly what the charges would be and also recorded my agreement to accept said charges. Too bad AT&T did not have the professionalism to do the same, because, having done so, this situation would then not exist. I can only conclude that with all their experience at bullying the consumer, AT&T is confident that they do not have to bother to record any agreements with consumers because they can just do their corporate bully act and get paid no matter what. I will not pay for something that I did not buy and I did not buy AT&T’s connection fee!! |

When I signed up for service (I was on my cell phone) they said to give it 24 to 48 hours for phone to be connected. When it didn't come on, I called AT&T and they said I needed to get new jacks installed. So I cancelled service and went with Time Warner. So, I never used the service, it was never turned on...I cancelled withing a few days and they still charged me $131.00. Baloney. |
