I have figured out a way to decline the pet over population, which will likely abolish puppy mills and unethical backyard breeding while still preserving the rights to breed.

The plan is simple, a law will be passed where it is mandatory to have every unaltered, breeding animal, and it's offspring microchipped permanently with the breeder's information before the animal is re-homed.

How this works, is when an animal from that breeder ends up at a shelter, the animal is to promptly be altered (spayed or neutered) if not already, then sent to the original breeder to be re-homed, if conditions permit. If the breeder refuses to microchip, or if an animal is purchased from a breeder, and that animal is not microchipped, the breeder is to be reported. If the situation persists, the breeding animals are to be removed from the property, to be altered, then returned to the breeder if conditions permit. If that breeder purchases more animals to breed, but still refuses to microchip, the breeder becomes delinquent, and may face fines or court. This policy would apply to all breeders, including those who have retired from breeding.

What separates a backyard breeder from a responsible, ethical breeder, is most ethical breeders are willing to take the animal they bred, back and re-home them themselves. 

This policy will work. Most backyard breeders and pet mills do not want the responsibility of finding new homes for older animals that have been altered. Nor would they want to pay the extra money to have the animals’ microchipped. However, if someone is willing to deal with that kind of responsibility, they will have that right to breed. 

 With your support, animal mills will back out entirely, and a large majority of un-ethical breeders will reconsider using animals as a way to make money.
