The procedural implementation of this Act presently conflicts with the constitutional rights of Aboriginal peoples. My Development Studies professor at Queen's University is currently incarcerated as a result of the provincial court refusing to acknowledge the constitutional right of Aboriginal peoples to consultation regarding the commercial develpment of territory subject to disputed land claims.

155 Glenn EastabrookI would hope that the Premier is a principled human being--his refusal to call a moratorium on this case and premitting the situation to go to the Courts with obstruction/contempt of court charges against Mr. Lovelace resulting with the excesive fine and jail sentence has challenged that hope. The Premier, in the name of justice, must intervene and require that the charges and subsequent sentencing be appealed and that Mr. Lovelace be released from jail and that the fine be suspended until a higher court has reviewed this whole matter (the initial charges and the lower court procedings.

However in light of the events of last week and the jail time given to Bob Lovelace and the fines imposed it becomes more important. This could happen to anyone who stands up for their rights here in Canada. I am extremely disappointed in the McGuinty government's non action on this issue.

181 Dr. Brydon GombayThe harsh sentence of Robert Lovelace and Chief Paula Sherman must be an example of exemplary sentencing rather than of justice. Surely the power of mining companies should not over-ride land claim negotiations which have not yet been completed? I've recently returned from New Zealand, where Maori rights are respected. We have much to learn from them, and it's clearly time for urgent reform of the Ontario Mining Act.
182 Laura LepperMr. Mcguinty, I witnessed the trial wherein my professor, Robert Lovelace, the chief negotiator for the Ardoch Algonquins First Nations (along with two other noble community leaders) were charged for contempt of court. They peacefully protested on the land in question as a last resort when the Ontario government failed to consult with them regarding the proposed drilling. I am outraged at the harsh sentencing of Robert Lovelace, being 6 months in jail and a fine of $25,000 (subject to increase since Frontenac Ventures is placing further fines). However, I am even more outraged and deeply disappointed in the Ontario government for their failure to respond appropriately to this environmental, Human Rights and First Nations issue. I look forward to seeing the government respond now to this proposal to remedy the current situation. Thank you.

187 Dr. Edwin DanielIt is quite unacceptable that Canada's Native Americans have their rights violated on a regular basis, that they are not consulted about issues that affect them and disputed land (for which no progress is made toward settlement) and that they are placed before the Justice system and sentenced when they take actions to protest. Mr. Harper has shown his disdain for justice fir First Nations people. Is that you position as well? I hope not. Please act to reverse this travesty.

Is it "just" that people who peacefully defend the health of their community be fined and imprisoned? I ask you to please consider what is at stake, that being, the health of our children and a clean environment. Policies can be made that value people's lives, rights and responsibilities over a dead-end dollar sign. The Chiefs and representatives of Ardoch are fighting for this and sacrificing a great deal to ensure a healthy future for their children. This is your time to prove that people matter to you and your party.

194 Liisa L. NorthIt seems outragoues to me that, first, we (non-natives) robbed almost all the lands of the original people, then refuse to negoitate disputes about the remaining lands, introduce polluting and dangerous industries to those areas, and then jail the indigenous people who protest!
