I am a Chinese, a better student and citizen, and a best Communism pursuer. But my educational right for MS degree of medical graduate school has been suppressed just before my graduation by Chinese Premier in position, Li Peng. I have exhausted all domestic remedies to seek my educational right. But no fair treatment is given to me. So I submit my complaint to International Covenant on Civil and Political Rights for fair treatment. Because <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com:office:smarttags" />China is not a State party to the Optional Protocol. The United Nations Office of the High Commissioner for Human Rights is not in a position to assist me in the matter I raise. Educational right is a basic right of civil and political rights in China and around the world. In the later years, after being expelled from graduate school of Chinese Academy of MedicalSciences & PekingUnionMedicalCollege(CAMS & PUMC) and suffered educational abuse by the Chinese leader, I have been suffering from lots of other unfair treatments, torture and other cruel, inhuman or degrading treatment or punishment. Which have been being all acted against basic human rights. The one of the most deadly shamefully torture and other cruel, inhuman or degrading treatment to me is that all my brain thinking has been being transmitted to all other people. My individual petitions on human rights violations by China should be assisted and helped by all other countries and international organizations around the world.<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" />

 I demand in this petition that by means of international help or help of Petitions Team, Office of the High Commissioner for Human Rights and all other countries and international organizations around the world, the Chinese authorities shall give me back my official postgraduate certificate and official postgraduate degree certificate of Master of Science immediately. I also demand in this petition that by means of international investigation or settlement of Petitions Team, Office of the High Commissioner for Human Rights, the Chinese authorities shall give me money compensation calculated by my losing of money after the official postgraduate certificates has not given me at 1991, my postgraduate student graduating year. Which are more important.

  The other unfair treatments, torture and other cruel, inhuman or degrading treatment, especially my-brain-thinking-transmitted-to-all-other-people should be stopped at once.

I was expelled from Cancer Institute, graduate <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com:office:smarttags" />school of Chinese Academy of MedicalSciences & PekingUnionMedicalCollege (CAMS&PUMC) as a postgraduate student just before graduating and just before getting my graduate certificates without any right lawful support by the CAMS&PUMC in November, 1990.<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" />

In April, 1999 to April, 2000, in order to seek fair treatment, I took the issue of my being expelled from graduate school of CAMS&PUMC to the Chaoyang district court of Beijing. At the critical time of court investigation, when the Chinese Academy of Medical Sciences & Peking Union Medical College were going to lose the lawsuit .The CAMS & PUMC handed out a paper and said that this is the paper of “The Premier had signed and ordered the expelling (me from the graduate school of CAMS & PUMC)”.So the Chaoyang district court of Beijing judged against the law and facts, did not fair me and did not give me the graduate certificates and compensations.

The Beijing Chaoyang district people’s court for my issue recording materials number is No.6900 in year 1999 civil judicial procedure.

In September 1, 1988, I was enrolled into cancer institute, ChineseAcademy of MedicalSciences & Peking UnionMedical College as a top postgraduate student for Master of Science degree. In November 24, 1990, I was expelled from the school by the Chinese Premier in position, Li Peng.

In the studying time of graduate school, I had finished and passed all my graduate school courses and research plans. My research has been finished. And I have finished extra research about cancer early diagnosis in my graduate school study time which has aroused much too influence among the society.

And there were three research papers had been published at three official medical Journals. One of the three official medical Journals is the best Journal in the related medical field in China. The best Journal is the Chinese Journal of Preventive Medicine (CJPM).

Now, the Chinese Journal of Preventive Medicine (CJPM), one of the first-class periodicals in preventive medicine in China, has been enjoying its precious academic reputations for a long time. Due to CJPM's profound academic influence, it has been retrieved by more than 20 critical databases at home and abroad, including Medline, Chemical Abstracts (CA), Biological Abstracts (BA), Russia Abstracts, CNKI, Chinese Academic Periodicals ( compact disk), CJFD, CAJCED, CBM, CMCC, Wan-Fang Info Site, Digests of Chinese Academic Periodicals (Chinese and English versions), etc.

In China or in other countries, the bad or the better of the graduate school education is marked by the publication of research paper done by the graduate school student. So my graduate school study must be graduated when all my graduate school courses and research plans have been finished and passed. And more than three research papers have been published, including the best Journal in the related medical field in China. Giving back my graduate certificates has been being more right in law and regulation at my graduate study time.

It was very shamed worse doing by the Chinese official, the Chinese Premier in position, Li Peng and the CAMS&PUMC when they expelled me from the school without any official notice to me. Which is the basic pre-condition to expel a student in China and other countries.

After my issue for fair treatment was defected by Beijing Chaoyang district people’s court and the Chinese Premier in position. I had taken my issue to the Procedure for Trial Supervision in China. I had applied to the Beijing Chaoyang district people's court which originally tried the case and to a people's court at the next higher level for a retrial. But they all denied the retrial. I again applied people's procuratorate for lodging a protest. The people's procuratorate was also denied the protest.^[1]

The retrial by people's court and the protest by the people's procuratorate are the only remedies available in our country to seek fair treatment in civil procedure of law. In addition, I have applied the petition departments of the authorities. They all denied any fair treatment.^[2,3]

In 2005, I again attended the national postgraduate school enrollment exam for medical graduate school of Zhejiang University. The related authorities had lowered my exam marks. Which made me did not pass the enrollment. I have applied the petition departments of the authorities for fair treatment at ZhejiangProvince. But they denied any fair treatment.^[4,5] This fact only to express that Iwas again suffering from education setback by denying enrollment of another graduate school by Chinese authorities.

After I lost my postgraduate certificates. My work, life and promotion have been being reduced to the lower level. And my contribution to mankind has been being limited hugely.

Like other countries all over the world, the Constitution of the People's Republic of China declared the right to be educated to any Chinese citizens. As the Constitution Article 46 stated. Citizens of the People's Republic of China have the duty as well as the right to receive education. The Constitution also stated. The State respects and preserves human rights. Freedom of the person of citizens of the People's Republic of China is inviolable. ^[6]

The Constitution Article 38 stated. The personal dignity of citizens of the People's Republic of China is inviolable. Insult, libel, false accusation or false incrimination directed against citizens by any means is prohibited.

While the Chinese Constitution protect the citizen of me to have basic right of education and other rights. But the Chinese high official, the Chinese Premier in position, Li Peng directly has interfused and ended my graduate study. Which openly acted against the Chinese Constitution and laws. Further more, after I was expelled from medical graduate school, Iwas again suffering from education setback by denying enrollment of another graduate school by Chinese authorities.

So shamefully and human-rights abused, the Chinese leader, Chinese Premier in position, Li Peng, has been destroying an innocent Chinese of me to contribute more to mankind.

By the evidences of written at above paper, the Chinese authorities have denied my right and duty to receive postgraduate certificates of education.

In the later years, after being expelled from graduate school of Chinese Academy of MedicalSciences & PekingUnionMedicalCollege(CAMS & PUMC) and suffered educational abuse by the Chinese leader, I have been suffering from lots of other unfair treatments, torture and other cruel, inhuman or degrading treatment or punishment. Which have been being all acted against basic human rights. The one of the deadly shamefull torture and other cruel, inhuman or degrading treatment to me is that all my brain thinking has been being transmitted to all other people.^[7]

3. Have exhausted all domestic remedies.

By seeking my postgraduate certificates and compensation, I have exhausted all domestic remedies. So I take my petition to Petitions Team, Office of the High Commissioner for Human Rights of UN for fair treatment. I also take my petition to all other countries and international organizations around the world.

4. Demands.

I demand in this petition that by means of international help or help of Petitions Team, Office of the High Commissioner for Human Rights and all other countries and international organizations around the world, the Chinese authorities shall give me back my official postgraduate certificate and official postgraduate degree certificate of Master of Science immediately. I also demand in this petition that by means of international investigation or settlement of Petitions Team, Office of the High Commissioner for Human Rights, the Chinese authorities shall give me money compensation calculated by my losing of money after the official postgraduate certificates has not given me at 1991, my postgraduate student graduating year. Which are more important.

  The other unfair treatments, torture and other cruel, inhuman or degrading treatment, especially my-brain-thinking-transmitted-to-all-other-people should be stopped at once.
