We the residents of the City of Opa Locka FL ask all residents, neighbors and our community to stand together and help stop the recycling company, (TMR) TRADEMARK METALS RECYCLING LLC which refuses to stop recycling metal from 3:00 AM - 7:00 AM.

For over 2 years now this company who claims to be a "Good Neighbor" hasn't allowed residents to sleep as they continue using their cranes to crush metal within feet of residential buildings. The Pink Apartments and The Gardens Apartments in Opa Locka, Florida, were constructed back in 1971 long before this company established itself in 1998.

The company, Trademark Metals Recycling LLC, stops its cranes from 4pm till 3am. I ask myself....What is this company doing at 3am that it can't do from 4pm-10pm? Residents have begged for them to please stop. Imagine renting an apartment on a yearly contract, paying your rent only to hear crushing metal all night long. Parents have stated "my oldest child wakes up at 4 am with nightmares" as she is breast feeding her new born child.

Another parent stated "fumes and odor come from their recycling".

The Dade County Fire Department records show this company has had prior fires and employee injuries. So why do they continue performing work off hours?

Trademark Metals Recycling LLC falls within a commercial zone with only an 8 ft wall and a few feet separating it from 3 story residential buildings. But if it truly is a company who cares about their community, why do they ignore the residents?

Trademark Metals Recycling LLC refuses to follow City Code compliance:

Sec. 15-73. - Prohibited generally.

It shall be unlawful to make any loud, unnecessary, excessive or unusual noise within the city.

(Code 1955, § 16-43)

Sec. 15-79. - Hours for use of noisy construction equipment.

It shall be unlawful for any person in conducting any building operations between the hours of 10:00 p.m. and 7:00 a.m., to the following day to operate or use any pile-driver, steam shovel, pneumatic hammer, derrick, steam or electric hoist or other apparatus, the use of which is attended by loud or unusual noise, except by written permission of the city manager, and then only in case of emergency.

Please help us stop this company and bring peace back into these residents lives.
