DECLARATION AGAINST PRE-EMPTIVE WAR AND GENEVA CONVENTION VIOLATIONS

This Declaration and Petition is meant to empower an international movement aimed at preventing "pre-emptive wars" - whether launched against Iran or any other nation - to help limit the duration and destructive effects of any such wars, and to help lead to the permanent abolition of war, as a means of settling disputes.

WHEREAS, the current administration of the United States and several other nations have violated their endorsement of the UN Charter by proclaiming an unprecedented "right," not recognized in law, to pre-emptively attack nations claimed to constitute a threat, and

WHEREAS, our nation's ratification of the UN Charter obligates our government and other member nations to avoid the use of armed force except when: a) clearly in self-defense or; b) pursuant to a Security Council Resolution (according to "common interest" principles); while our Constitution vests "war powers" in the Congress, not in the executive branch of government alone, and

WHEREAS, the bypassing of such obligations, as with the invasion of Iraq, has caused untold suffering and the death of hundreds of thousands of innocent civilians - alongside thousands of American and international war participants - alongside the vast drain of resources needed for constructive purposes in our world, and

WHEREAS, the same kinds of exaggerated threats are again being circulated with regard to Iran; thereby threatening to take our world further into needless suffering and darkness, while building great debts and deficits of goodwill to darken the horizons of succeeding generations;

THEREFORE, we, the Undersigned - as moral and sovereign citizens, those to whom our executive, legislative and military leaders are accountable

DEMAND THE FOLLOWING;

I. That our administration and those of other UN member nations immediately cease all movement toward additional "pre-emptive" wars;

II. That our national political leaders redirect our national treasure - being wasted upon speculative wars and drained via corruption and war-profiteering - toward humane and constructive uses, including urgent humanitarian needs at home and abroad;

III. That the Attorney General of our nation and the magistrates of the International Criminal Court proceed with the conviction of any persons that have violated international war crimes statutes or the Geneva Conventions, to assist our society in re-establishing basic principles of civilized and lawful conduct.

IV. We, the Undersigned, demand an end to all unjust and illegal behavior being committed "in our name," and demand the creation of a just and humane world in its place; the creation of a world without war, made possible via the creation of greater social, political and economic justice.

BACKGROUND INFORMATION

Many American and other citizens do not realize that when our Congress ratifies a treaty - as with the United Nations Charter (1945) – that its statutes then become (according to Article VI of the U.S. Constitution), “the Supreme Law of the Land,” and U.S. federal law. This means that the current “pre-emptive war” in Iraq – which bypassed the UN Security Council and violated core tenets of the UN Charter - was both a violation of U.S. federal law, and a violation of the UN Charter. The same may be said of recent court rulings, which indicate systematic violations of the Geneva Conventions.

We, as members of the United Nations Association, uphold the principles of cooperation and respect for law among nations, and encourage the development of a more humane and decent world. We ask that all who honor these principles consider signing our Petition, and making known to your friends, relations, co-workers and elected officials your demand for principled behavior on the part of our government.

The following text quotes from the Preamble to the Charter of the United Nations, which came into force as U.S. federal law in October, 1945.

WE THE PEOPLES OF THE UNITED NATIONS DETERMINED;
to save succeeding generations from the scourge of war, which twice in our lifetime has brought untold sorrow to mankind; and to reaffirm faith in fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small; and to establish conditions under which justice and respect for the obligations arising from treaties and other sources of international law can be maintained, and to promote social progress and better standards of life in larger freedom;

AND FOR THESE ENDS;

to practice tolerance and live together in peace with one another as good neighbors, and unite our strength to maintain international peace and security; and to ensure, by the acceptance of principles and the institution of methods, that armed force shall not be used save in the common interest; and to employ international resources for the promotion of the economic and social advancement of all…
