It has come to my attention that you have in your possession a petition for Commutation of Sentence for an inmate named Timothy S. Caffery DOB 5/28/1963. I understand that the crime for which Mr. Caffery has been convicted is a serious one, but feel that he has adequately paid his debt to society
The South Dakota parole board, created to guide your decision making in this process, has unanimously approved Mr. Caffery's petition. Your signature on this petition will not diminish the seriousness of his crime, nor will it in any way abort justice, it will only support the just and equitable treatment of a human being who has paid the debt required of him under the law. I ask that you please sign Timothy Caffery's petition for commutation of sentence and immediately release him from prison.
I also respectfully ask that Attorney General Larry Long, a longtime friend of the victim in this case, please recuse himself from any further involvement. Although I'm sure that his character is of the top most stature, his friendship with the victim and his involvement in this case casts a questionable appearance on the proceedings.
Timothy Caffery's young life was riddled with abuse, a fact that was attested to by the minister's wife during his trial. He has now served 27 years for a charge of manslaughter, a sentence out of balance with the average time served for such an offense. During his time in prison he has been a model prisoner and he has grown into a man who is ready and capable of resuming his life in society. He has an extensive network of support waiting to receive him and assist him as he makes his transition back into his community. It is time for Timothy to be allowed to return to his home community so that both he and his community can begin to heal.
Thank you for considering my request and for honoring the execution of justice that has been entrusted to you, by releasing Timothy Caffery from prison. |
