Special Education Needs Accountability

Jeanette Arends and Tammy Robinson are parents of children that are being denied services and accommodations in the current publicly funded education system in Ontario. Over the past couple of years it has come to their attention how poorly the education system is doing in educating children that have any type of special need and or learning disability. It does not matter what your child's needs may be as all children who have exceptionalities are being denied their right to an individualized, specialized education. These two moms’ have supported many parents in helping to advocate for their children. These moms are well educated in what every child is entitled to receive under the Ministry of Educations legislive policies. While knowing what the child needs and or what the child is entitled to does not mean that the current system has anyone to answer to when they choose to deny these children their rights. Jeanette and Tammy realize that the only way the system will change and be held accountable for their actions is to unite with all other parents to form one voice. These two moms’ have gathered a group of parents in Ottawa Canada to join forces to try and bring some accountability and resolve to this ever increasing problem. Our group has been given some solid legal advice as to what it will take to bring a class action suit against any and all that are responsible for the denial of services and accommodations for our children. We are looking for anyone that has a child that has experienced, or is experiencing difficulties in school because of their unique needs and or learning disabilities. Have you as a parent had problems achieving that level of understanding for your child with your school, your board or even with your respective Ministries of Education? Is the school or the board denying your child what they need? Have you been denied meetings or full participation in your child’s education while trying to help your child get the understanding and accommodations they may need? Is your child struggling with academics and or socialization at school? Is your child being mislabeled and or mistreated by the school and or your school board? Has the school refused to cooperate with you and treat you as an equal partner in your child’s education? If you answered yes to even one of these questions then this petition is for you. The difficulties can include but are not limited to:

Learning Disabilities of any kind
Autism Spectrum Disorders of any kind
Physical Disabilities
Hearing Impaired
Visually Impaired
Mentally Impaired, including mental illness (either diagnosed or not)
ADHD
Behavioural Problems
Discriminated against because of Disability or Special need
Safe School’s Policy

You can be with the Public Board, the Catholic Board, the Separate Board and or any other board of Education in the Province of Ontario and or from any other province.

Your child does not have to have an official diagnosis or labeled with anything to join this fight against any and all levels of education in this country. All children have the right to go to school at age 6 in Canada. Education is a right, not a privilege. It is time that our schools, their boards and the Ministries Of Education be held accountable by the courts in our country to ensure that all children are fully included and given the education to suit their needs. Without a precedent setting court ruling in Canada, things will only get worse. There is no accountability in our current education system. This is your chance to bring that much needed accountability and change to the current education system.

The more parents that join in this class action movement the bigger the impact it will have. This is not just a problem in our city, but all cities, towns and or communities in the Province of Ontario and or the Country of Canada

We plan to form this petition and leave it open so as many parents as possible can sign their name indicating they wish to join the movement to bring sweeping changes in the delivery of services and accommodations in special education and how it is delivered to our children.

Tammy Robinson and Jeanette Arends are the founders and designated spokespeople for the group. The Petition will go to them first and then they will turn it over to the lawyer involved, Mr. Arthur Cogan. Our concerns were validated by Mr. Cogan and he is willing to work with all who would like to join in. Mr. Cogan is a very high profile litigator that was awarded the largest financial settlement in Canada for a Class Action Suit he took to court and won. If anyone can bring about the results we are looking for, Arthur Cogan is the right man to do so.

Tammy Robinson has an 8 yr old daughter that is diagnosed with an Autistic Spectrum disorder known as a Nonverbal Learning Disability. NLD is characterized by a gifted left brain but an equally disabled right brain. Sensory/Self Regulation disorder is extremely predominant in the NLD child. Educating the NLD child is extremely difficult because the child is assumed to be much more capable then they are because of their eloquent vocabulary and very early language abilities. It has been a struggle for the child and the child is paying the price for the continued ignorance from the education system.
Jeanette Arends is a single mother of 2 in the current education system. The 17 yr old just returned to school after almost 4 years of no formal education. He could not cope past grade 7 because of the school system refused to accommodate this child. He has Aspergers and Bipolar disorder. He was mislabeled and mistreated for years which caused the child severe anxiety which forced him to stop attending school. Her other son has severe language disabilities. While he was identified at a very young age as having these disabilities he continues to struggle despite interventions taken on the part of his mom. Every child deserves an education, not just the chosen ones.

These two mothers have come together to unite in the cause and join the class action suit to help bring accountability to ensure change in our education system for all children with different abilities.
