PERRY/BOLTON TAX ALLOCATION DISTRICT PETITION TO
THE MAYOR OF THE CITY OF ATLANTA, ET AL.


The undersigned hereby petitions –
•the Mayor and Councilmembers of the City
of Atlanta;
•the County Commissioners of Fulton
County; and
•The Atlanta Development Authority (“ADA”)
to :
1. pursue a workable, fair and just plan to implement the Perry/Bolton Tax Allocation District (hereinafter “PB TAD”), and reduce the amount of the stated affordable housing component in the PB TAD to not more than 20% -- in line with all the other TADs;

2. remove entirely the punitive provisions contained in the PB TAD;

3. remove entirely the provision that a developer not seeking PB TAD funds is bound by the PB TAD requirements.

4. implement a fair, accurate and precise method of measuring implementation requirements that will not overburden the ADA, the City of Atlanta, or the Fulton County Commission;

5. push forward the much-needed projects, including, but not limited to the following current projects:
•Fire Station 28 / mini police precinct /
community center;
•AGAPE Center expansion;
•Greenspace acquisition and development;
•Perry Library
•Burtz Street West development (Rod Batiste)
•James Jackson / Bolton Rd. development (Orinda
Corporation);
•Restaurant / condo. development on Bolton Rd.
(Alan Joel & Associates);
•Moores Mill Shopping Center redevelopments
(Edens & Avant);
•Developments on Bolton Rd./Marietta Rd. Phase
III of the Du Pont Commons housing development,
and West Highlands housing development (Brock
Built Corporation);
•Perry Blvd./Hollywood Rd. redevelopment
(Wood Partners)

The PB TAD district needs more retail in our area so residents can spend their income in Fulton County, and not Cobb County, and therefore keep tax dollars in Fulton County for the benefit of Fulton County residents and school district. The TAD at a 20% level is workable, and developers have been able to factor that into their development. The above developers have expressed doubt and/or inability to comply with the 40% requirement, which would result in developers downsizing, ‘cheapening,’ abandoning their projects, and much needed affordable housing NOT being built at all.

Bond underwriters for the City of Atlanta, the ADA and Fulton County need to work together as a team to craft workable language to move forward as well as to allow bonds to be issued at favorable rates.
