I, the undersigned, a member of the European Union, and/or of Turkish Cypriot nationality, call upon Members of the European Parliament to: Uphold the property rights of all nationalities living in Northern Cyprus granted to them in good faith by the Turkish Cypriot Government. Insist that any Greek Cypriot challenging this should go through the proper channels i.e. The Immoveable Property Commission of North Cyprus for compensation for any loss of property in 1974 that they can substantiate. Remember that the European Court of Human Rights held in its just satisfaction judgment of Xenides-Arestis v. Turkey that the Immovable Property Commission has, in principle, taken care of the requirements of the European Convention on Human Rights. Rule that individuals should not be allowed to prosecute other individuals concerning property rights through the judicial system. Greek Cypriot grievances should proceed through The Property Commission and not through the courts. Concur with the ruling of the English High Court in the case of Apostolides v. Orams. Urge the European Court of Justice to confirm that the South has no jurisdiction over causes of action relating to Northern Cyprus whereby in the case of Apostolides v Orams and that EU acquis will not be applicable in violation of European Union primary law, The Accession Treaty of South Cyprus to the EU. BACKGROUND: In 1974, after 20 years of struggle between the Greek and Turkish Cypriots, Cyprus was divided. Turkish Cypriots went to the north of the island, leaving behind land and property. Most arrived with no material possessions, jobs or money. The international assistance for refugees from both the Greek and Turkish Cypriot communities was channelled primarily to the Greek Cypriot side. The administration in the north, faced with this critical problem, allocated land and property to the Turkish Cypriots based on the extent and value of that which they had to abandon in the south. This enabled Turkish Cypriots to have a roof over their heads and, in many cases, to use the land to live off. The sanctions which have been applied to North Cyprus since 1974 meant it was inevitable that both land and property would be traded to augment income and to enable Turkish Cypriots to survive. In 2002, British couple David and Linda Orams bought a property in North Cyprus in good faith and hold deeds showing legal entitlement given them by the authorities of the TRNC.
